NOTICE OF COMPLETION OF A DRAFT ENVIRONMENTAL IMPACT STATEMENT
NOTICE OF PUBLIC COMMENT HEARINGS

The purpose of this notice is to announce the completion and issuance of an integrated Draft State Energy Plan (Draft Plan) and Draft Environmental Impact Statement (DEIS), to solicit written comments on the Draft Plan and the DEIS and oral comments at a series of public meetings to be held across the State, and to inform the public of the procedure for requesting evidentiary hearings in the event that there is any dispute as to material facts contained in the Draft Plan.

Issuance of the Draft Plan

The Energy Planning Board has issued a Draft Plan which contains, among other things, the forecasts and assessments required by Article 6 of the Energy Law and addresses the issues identified by the Board in a Public Notice published in the State Register on April 18, 2001. The Draft Plan is intended to provide strategic direction and guidance and to coordinate state government’s energy-related activities over the next several years.

Completion of the DEIS

The Energy Planning Board, as lead agency, has completed a DEIS pursuant to Article 8 of the Environmental Conservation Law relating to the preparation and issuance of the Draft Plan. This is an unlisted, statewide action under the State Environmental Quality Review Act (SEQRA). The analysis constituting the DEIS is integrated with the Draft Plan and the Plan includes a separate section which outlines compliance with SEQRA.

Public Comment Hearings on the Draft Plan and the DEIS

The Energy Planning Board hereby gives notice that public comment hearings will be held for the purpose of receiving oral comments on the Draft Plan and the DEIS at the following locations and times:

Buffalo - January 23, 2002, 9:00 am and 1:00 pm at the Adams Mark Hotel, 120 Church Street, Buffalo, New York 14202.

Rochester - January 24, 2002, 9:00 am and 1:00pm at the Four Points Sheraton Rochester Riverside Hotel, 120 Main Street, Rochester, New York 14604.

Syracuse - January 29, 2002, 9:00 am and 1:00 pm in Grewen Hall at LeMoyne College, 1419 Salt Spring Road, Syracuse, New York 13214.

Binghamton - January 30, 2002, 9:00 am and 1:00 pm at the Best Western Binghamton Regency Hotel and Conference Center, 225 Water Street, 1 Sarbro Square, Binghamton, New York 13901.

Mineola - February 5, 2002, 10:00 am and 2:00 pm at the Long Island Marriot, 101 James Doolittle Boulevard, Uniondale, New York 11553.

In addition to these hearings, staffs of the Energy Planning Board agencies will be giving a technical briefing on the draft plan in Albany on January 15, 2002 at 10:00 am, at the Empire State Plaza, Meeting Room 7.

Submission of Written Comments

The public is also invited to submit written comments on the Draft Plan and the DEIS. Written comments should be submitted to Paul DeCotis at the address set forth below and must be received no later than 5:00 pm on March 15, 2002.

Requests for Evidentiary Hearings

Any interested person may request evidentiary hearings on the issues identified in paragraph 6-104(2)(a) of the Energy Law or on the factual basis for any other issue identified in subdivision 6-104(2). Any such request must comply with the requirements of 9 NYCRR 7848.4(a). The original and five copies of any such request must be served on the Board no later than March 5, 2002. The Board may be served by delivery to Roger D. Avent, New York State Energy Research and Development Authority, Corporate Plaza West, 286 Washington Avenue Extension, Albany, New York 12203-6399. Copies of any such requests must be served on all persons included on the Board’s service list at the same time as the request is served on the Board. A copy of the Board’s service list can be obtained from Roger Avent by writing to him at the same address or by calling (518) 862-1090, extension 3333. In the event timely requests for evidentiary hearings are received, the Board will issue a ruling as to whether such hearings are warranted and will specify the issues to be addressed.

Negative Declaration

Monroe County - The Village Board of the Village of Pittsford, as lead agency, has determined that the proposed Village of Pittsford Comprehensive Plan will not have a significant adverse environmental impact. The action involves the adoption of the Pittsford Comprehensive Plan by the Village Board: this action is pursuant to Village Law sections 7-722 and 7-741. The Comprehensive Plan includes the following chapters:

The purpose of the Comprehensive Plan is to provide guidance in the development of the future of the Village of Pittsford. The plan evaluates existing conditions, looks at trends and formulates polices that can be implemented by the Village to create a high quality community for existing and future residents.

Monroe County - The Planning Board of the Town of Brighton, as lead agency, has determined that the proposed application of American Tower Corp and Sinclair Broadcasting will not have a significant adverse environmental impact. The action involves site plan approval and steep slope permit approval to construction a 270 foot broadcast/telecommunication tower with a 50 foot antenna. The project is located on Pinnacle Hill in the Town of Brighton.

Monroe County - The Town Board of the Town of Chili, as lead agency, has determined that the proposed establishment of the Chili Sewer Improvement Benefit Area No. 1 will not have a significant adverse environmental impact. The action involves providing for a suitable sanitary sewer collection system to service residential, commercial and industrial properties in the Town of Chili.

Positive Declaration

Monroe County - The Planning Board of the Village of Honeoye Falls, as lead agency, has determined that the proposed West Main Street Development may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves approval for development of 96.2 acres formerly used as agricultural property and vacant land for commercial/industrial development. The project is located on Gleason Property, West Main Street in the Village of Honeoye Falls.

Positive Declaration and Notice of Acceptance of Draft EIS

Steuben County - The Bradford Central School District, as lead agency, has determined that the proposed Bradford Central School District Bus Garage may have a significant adverse impact on the environment and a Draft Environmental Impact Statement has been prepared. Written comments on the Draft Environmental Impact Statement will be accepted by the contact person until January 11, 2002. The action involves the construction of a bus garage and maintenance facility on the school campus. The project is located at 2820 Route 226, Bradford.

Notice of Acceptance of Draft EIS And Public Hearing

Monroe County - The Planning Board of the Town of Webster, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed St. Ann's Proposed Senior Living Community. A public hearing on the Draft EIS will be held on January 15, 2002 at 7:30 p.m. at the Webster town Hall, 1000 Ridge Road, Webster, New York. Written comments will be accepted until January 28, 2002. The action involves construct and operate a comprehensive senior citizen residential complex on approximately 42 acre site. The complex, as proposed, would include independent living townhouses (68), independent living apartment (140), assisted living apartments (51), special care facility for Alzheimer’s/dementia (52 beds), skilled nursing facility (106 beds), a community center and all related parking, driveways, drainage and utility improvements. The project is located at 860-876 Ridge Road, Webster, New York.

Seneca County - The Seneca County Board of Supervisors, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Seneca County Public Safety Building and Jail. A public hearing on the Draft EIS will be held on January 22, 2002 at 8:00 p.m. at the Seneca County Offices, 1 DiPrionio Drive, Board of Supervisors Room, Waterloo, New York. Written comments will be accepted until February 1, 2002 at 4:30 p.m. The action involves construction of a County Public Safety Building on one of two potential parcels, both of which are located at the northeastern corner of the intersection of Kingdom Road and County House Road.
