Project Description:

The Town of Phelps proposes to create the Spafford Road Water District and to take for use therein a supply of water estimated to average 5,000 gallons per day from the Village of Newark’s Canandaigua Lake source via the Town of Phelps. The project includes the installation of 5,150 lineal feet of 8" PVC and 180 lineal feet of 8" HDPE water main and appurtenances to serve 19 residences along Spafford Road. The Town of Phelps has received some financial assistance toward the district facilities from the Department as a result of groundwater contamination issues. The file is available for review and comment at the NYSDEC Region 8 office.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: Phelps Town Board
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Jan 11 2002.

Project Description:

Seneca Meadows, Inc. (SMI) has requested a Part 360 Solid Waste Management Facility Permit Modification to revise the primary liner system and to reduce the soil sampling and testing requirements for certification of the liner system. The change to the primary liner system includes substitution of the top 6-inch portion of the low permeability soil layer with a geosynthetic clay liner GCL (in areas where stability is suitable based on slope and other design criteria). This substitution is included in the 360 regulations and has been shown to be at least as effective as the soil material. Subsequently, SMI has requested a variance from 360-2.13(j)(i) to eliminate the 12-inch layer of structural fill within the primary liner system. This 12-inch layer was required to protect the secondary liner system below it from being damaged by the compactive efforts required to achieve the low permeability requirements of the upper 6-inch soil layer of the primary liner. Because the 6-inch soil layer is being replaced by the GLC, compaction of the primary liner is not required, therefore, the 12-inch layer will no longer be needed. The Department concurs that the approval of this variance will not result in a system less protective of the environment, and proposes to issue a permit modification with the condition that SMI provide a secondary layer of GCL beneath areas containing leachate collection pipes in the primary leachate collection and removal system, where concentrated flow is expected. This variance has been granted previously to other applicants including the Broome County landfill. In addition, the request to reduce the soil sampling and testing frequency requires two variances from 360-2.13(l)(3)(i). The Department concurs with the approval of these variances because the reductions are based on the proven consistency of the soil properties demonstrated by data generated over three construction seasons and therefore proposes to modify the permit. The project file is available for review and comment at the regional NYSDEC office.
