Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the federal Clean Air Act Amendments, and made tentative determination to approve this application for the operation of the applicant's existing two medical waste incinerator units. The draft Title V permit includes conditions from the original Air Permit for the operation of two incinerators based on 6 NYCRR Part 201- Permits and 6NYCRR Part 219-3 Infectious Waste Incinerator Facilities.

This draft permit also incorporates revised mass emission limits in pounds per hour for trace metals, hydrogen chloride and organic compounds. These State enforceable limits are revised based on an existing permit condition which allows the applicant to request for a permit modification to increase to levels reflective of the site-specific stack test results provided that the emission rates meet the Department screening criteria. As part of this process, the applicant submitted an ambient air quality impact analysis to evaluate air quality impacts associated with the proposed emission limits with respect to short-term guideline concentrations and annual guideline concentrations established through the Department Guidelines for the Control of Toxic Ambient Air Contaminants (DAR-1).

Based on a Compliance Schedule included in the draft permit, the facility will be subjected to federal regulation 40 CFR 60, Subpart Ce (Emissions Guidelines and Compliance Time for Hospital/Medical/Infectious Waste Incinerators). All Subpart Ce requirements are included in this permit. When overlap, the permit contains the most stringent limits, which includes emissions limits, monitoring conditions and record keeping requirements.

The Application, Draft Permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing Notices will contain instructions on filing for party status and submitting comments. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
