DIVISION OF SOLID & HAZARDOUS MATERIALS

PROPOSED REPEAL AND ADDITION OF SOLID WASTE REGULATIONS 6 NYCRR
SUBPARTS 360-4 AND 360-5
and Associated Amendments to Part 364, Part 621 and Subparts 360-1

Notice is hereby given that the New York State Department of Environmental Conservation (NYSDEC), pursuant to Environmental Conservation Law Article 27, Title 7 and Title 9, will hold a Legislative Public Hearing on NYSDECís proposal to repeal and add the SOLID WASTE REGULATIONS contained in Subparts 360-4 and 360-5 and associated changes to Part 364, Part 621 and Subpart 360-1 of Title 6 of the Official Compilation of Codes, Rules and Regulations (6NYCRR) of the State of New York.

This action will update the Departmentís current Part 360, Part 364, and Part 621 regulations as they relate to the recycling of organic waste through composting and other means. This update will bring the Part 360 regulations into conformance with federal regulations governing the beneficial use of sewage sludge and will provide needed updates to other technical criteria. These revisions will eliminate unnecessary confusion caused by state regulations that do not include federal criteria; are a necessary step leading to delegation of the federal biosolids program; and will update the technical criteria for non-federally regulated facilities (yard waste composting, etc.) which have not been revised since 1988.

A legislative public hearing will be held at the William K. Sanford Town Library, 620 Albany-Shaker Road, Loudonville, New York 12211 on Friday, February 15, 2002 at 1:30 p.m. This hearing location is accessible to handicapped persons. Interpreter services shall be made available to deaf persons at no charge, upon written request received within a reasonable time period prior to the scheduled hearing.

All persons, organizations, corporations, or government agencies, etc.,which may be affected by the proposed amendments are invited to attend the hearing and to submit either written or oral statements. The hearing session will continue until all persons wishing to make statements have been heard. Written statements received prior to or during each hearing session and oral statements made at each hearing session will be given equal weight. It is recommended that lengthy statements be submitted in writing.

6 NYCRR Part 219-2 is being promulgated, and Subparts 219-1 and 2 are being amended to lower the emission limitation for mercury for large municipal waste combustors to the level proposed in the Conference of New England Governors and Eastern Canadian Premiers Mercury Action Plan.
