The project proposal consists of the development of 44 apartment units on a 10.5 acre parcel of land owned by Charles Crisafulli. Development will also include associated roadway, parking areas, and utilities. Impacts to federal wetlands will be associated with the construction of asphalt driveways, parking areas and building construction and grading. Total impacts to wetlands will be approximately 0.29 acres. This impact will be offset by the creation of 0.27 acres of scrub/shrub and emergent wetland communties and the establishment of a conservation easement or deed restriction on the 0.27 acres of created wetland and an additional 1.09 acre buffer area. The project site is located on NYS Route 9W approximately 1/2 mile north of Fuera Bush Road, in the Town of Bethlehem, Albany County.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

The Department has made a tentative determination to approve an application for a modification to an existing permit's (NY0191973) discharge limits for zinc and iron. The modification would increase the discharge limits for zinc from 0.007 lb/day to 0.0225 lb/day, and iron from 0.054 lb/day to 0.20 lb/day. Due to the proposed modification for iron limit and the complex nature of the effluent, the permit would also add requirements for Chronic Toxicity Testing. Stiefel Labs is a phamaceutical manufacturing facility located on Route 145 in Oak Hill, Town of Durham which discharges up to 0.0216 MGD of treated wastewater to a Class C trib of Thorpe Creek. Draft modified permit pages are available for review at the Regional Office.

The applicant proposes to construct a new residential subdivision on a 106 acre parcel of land. The project will consist of 74 individual building lots, with 5,600 linear feet of new roadway and 2 stormwater management areas. Approximately 49 acres of the property will remain as undeveloped open space. The project will necessitate the filling of 1.51 acres of federal wetland, which includes 0.01 acres of state wetland. Approximately 1.51 acres of wetland adjacent area will also be disturbed to by the construction of the stormwater management areas. New wetland areas, totaling 1.58 acres, will be constructed as mitigation for the wetland disturbances. The project site is located at the northern end of the Village of Scotia in the vicinity of Glen View Drive North and Red Coach Drive.

The applicant proposes to open a new mine site to extract limestone. The life of mine area will be approximately 3.2 acres in size and excavation will occur to a depth of approximately 25 feet. Project Description:

The Department has received an application from Knolls Atomic Power Laboratory (KAPL) to modify existing air permits at their River Road facility. These modifications are being proposed for the purpose of establishing certified Emission Reduction Credits (ERC's) for past emission reductions which are the result of changing the type of fuel burned at the facility from #6 residual oil to natural gas, with #2 fuel oil used as backup. All the emission reductions were created at Emission Unit H-BOILR through Federally enforceable conditions. The State Facility Permit issued on April 4, 2000 limits total BTU's annually to 162,400,000,000. With this permit modification KAPL will be establishing ERC's, offstes/netting of 10.57 tons for Nitrogen Oxides and .07 tons for Volatile Organic Compounds in accordance with 6NYCRR Part 231 "New Source Review in Nonattainment areas".
