Project Description:

     The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the Applicant's facility located in Newburgh, New York.

     The permit will be an Air State Facility Permit to operate three boilers, four finishing frames, dye equipment and cloth printing and drying equipment.

     The boilers have heat input ratings of 32.658, 33.476, and 33.476 million BTU per hour. All three boilers burn natural gas and only boilers #2 and #3 burn number 6 oil. Boiler #1 is prohibited from burning oil to exclude the facility from being subject to the sulfur dioxide and particulate standards specified in 40CFR60Supbart Dc.

     There will be restrictions on natural gas and oil usage, in order to limit emissions of sulfur dioxide and oxides of nitrogen below 100 tons per year. Therefore, the facility is not subject to the requirements of Title V of the Clean Air Act, Prevention of Significant Deterioration (40CFR52.21), and Reasonably Available Control Technology for Oxides of Nitrogen (6NYCRR Part 227-2).

     The permittee will be required to maintain records and submit reports to demonstrate compliance with permit conditions and limits. The draft permit is available for review at the Region 3 office.

     By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

     The Application and Draft Permit are available for review at the Regional Office of the NYSDEC.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Jan 14 2002.
