Project Description:

The application is for a four (4) acre addition to the stockpile area of the applicant's "Franklinville Division Mine", contiguous with the south edge of the existing mine stockpile and processing area. Operation and reclamation of the additional area will be in accordance with previously approved plans. The mine is located east of NYS Route 16 with the entrance about 1800 feet south of Fox Road intersection.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Jan 4 2002.

Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a State Pollution Discharge Elimination System permit (NY-0259047) for the discharge of non-contact cooling water to the Chadakoin River which has a Water Index Number of Pa 63-13-4 and a classification of C. The permitted maximum discharge rate would be 10,000 gallons per day, with a maximum temperature of 90 degrees Fahrenheit. Temperature would be monitored monthly. Flows are metered on a continuous basis and recorded monthly. The draft permit, fact sheets, application, and applicable regulations are available for inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to the proposed permit may be made by filing a written statement by the deadline date indicated.

Project Description:

The Department has prepared a draft State Facility Permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL) and the Federal Clean Air Act Amendments for the Lakeview Correctional Facility, located west of County Routes 6/380, and made a tentative determination to approve this application. The facility operates three dual boilers (Natural Gas and No. 2 Fuel Oil) which are subject to the New Source Performance Standard (NSPS) 40 CFR60 Subpart Dc for small boilers for reporting and sulfur limits on its fuel oil. This permit contains federally enforceable permit conditions limiting the sulfur to no greater than 0.5 percent by weight, and at maximum output , the facility's emissions will be kept below 100 tons per year of sulfur dioxide, and therefore, the facility will not be subject to Prevention of Significant Control Requirements (PSD) under 40 CFR 52.21 and Title V permitting under 6 NYCRR Part 201-6. The Application and Draft Permit are available for review at the Region 9 Buffalo Office of the New York State Department of Environmental Conservation.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
