Project Description:

The applicant proposed to construct a17 lot subdivision, within a 91.6 acre parcel, adjacent to Rhoda Lake, Freshwater Wetland CO-7. The 17 lot subdivision includes two undeveloped common lots, one of which will be used for lake access. Total wetland impacts for the project are 0.013 acres of wetlands, 0.505 acres of adjacent area, and 78 sq. ft. of intermittent class C stream under federal jurisdiction (access road construction). The project includes grading for construction of a stormwater retention basin (0.44 acres), the installation of a seasonal floating dock (0.013 acres), and maintenance of a six foot wide walking trail for lake access (0.065 acres of adjacent area). The project is located on the north side of Upper Rhoda Pond, in the Town of Copake, Columbia County.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: Copake Town Board
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Applicant proposes to modify and renew their existing permit for a sand and gravel mine. Modification includes expansion of the Life of Mine from 15.1 acres to 26.2 acres, lowering the proposed mine floor from 465 feet to 450 feet above sea level, and revising the reclamation soil depth from 30 inches, to the depth of the existig topsoil plus at least 6 inches of upper subsoil.
