Region 9 - The Department of Environmental Conservation has determined that the Registry of Inactive Hazardous Waste Disposal Sites in New York State needs to be amended to delete site number 932068, known as the Botanical Garden Site. This site is located in the City of North Tonawanda in the County of Niagara and is located at Old Falls Boulevard. The reason for deletion is:

Negative Declaration

Erie County - The Town Board of the Town of Amherst, as lead agency, has determined that the proposed rezoning of property located at 2091 Sweet Home Road, from New Community District - Major Open Space (NCD-MOS), to New Community District - Local Center (NCD-LC) will not have a significant adverse environmental impact. The action involves the rezoning of 28.294± acres of land on the east side of Sweet Home Road, 1,600± feet north of its intersection with Skinnersville Road. The property to be rezoned is intended for the development of senior facilities. Property is located adjacent to Ellicott Creek.

Erie County - The Town Board of the Town of Amherst, as lead agency, has determined that the proposed Amendment to Town Zoning Ordinance, Telecommunications Facilities Section, will not have a significant adverse environmental impact. The action involves an amendment to Section 203-8-19.8D of the Town of Amherst Zoning Ordinance by excluding telecommunications facilities from undergoing a safety analysis if they are categorically excluded from such requirement under the rules and regulations of the Federal Communications Commission.

Erie County - The Town Board of the Town of Amherst, as lead agency, has determined that the proposed purchase of land from NYS Canal Corporation will not have a significant adverse environmental impact. The action involves the purchase of property by the Town of Amherst from the NYS Canal Corp. The property is located on the north side of Tonawanda Creek Road, directly adjacent to the NYS Barge Canal, and measuring 18.9± acres. There are no built structures on the property but the Canal Trailway traverses the site. The Town of Amherst intends to maintain the property as park/recreation/open space land. The land is within the boundary of the Local Waterfront Revitalization Program (LWRP) currently being prepared by Amherst in conjunction with the Town of Pendleton.

Wyoming County - The Town Board of the Town of Orangeville, as lead agency, has determined that the proposed Local Law No. 2 of 2001 entitled, "Amending the Zoning Law of the Town of Orangeville Relating to the Regulation of Towers" will not have a significant adverse environmental impact. The action involves regulating the siting of towers in various areas in the Town of Orangeville by specifically amending Article ll, Section Xl; Article lll, Section XXll; Article IV, Section XXXl, Section XXXlll, and Section XXXIV; Article V, Section XLl of the Town of Orangeville Zoning Law. The project is townwide.

Notice of Acceptance of Draft EIS and Public Hearing

Erie County - The Village of Hamburg, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Country Meadows. A public hearing on the Draft EIS will be held on December 20, 2001 at 7:00 p.m. at the Hamburg High School Auditorium, Legion Drive, Hamburg, New York. Written comments on the Draft EIS will be accepted until January 4, 2001 at 4:30 p.m. The action involves the consideration of an application for a Planned Unit Development District under the Village Zoning Ordinance by Clover Construction Management, Inc. (“CCM”) of Amherst, New York, on behalf of Country Meadows Associates, a New York General Partnership. CCM proposes to develop approximately 301 units of single family, patio home, condominium and multi-family housing on two adjoining vacant parcels of land located in the northwestern portion of the Village of Hamburg, Erie County, New York. One parcel is 22 + acres, and is currently owned by Country Meadows Associates and the second parcel, located immediately adjacent to the Country Meadows parcel to the east, is 15.06 + acres, and is currently owned by the Village of Hamburg, New York, which will be combined to make a unified project parcel for a total of 37.06 + acres. The proposed project is called Country Meadows.

Notice of Acceptance of Final EIS

Erie County - The Town of Grand Island, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Private Mesmer Airstrip. The action involves construction of a private airstrip on an approximately 16 acre site. The project is located at 2548 Love Road, Grand Island, New York.
