Amendments of the Final Freshwater Wetlands Maps

Delaware County - Subsequent to the promulgation of the final Freshwater Wetlands Maps for Delaware County on January 28, 1987, DEC Region 4 Staff found several inaccuracies affecting Maps 6-8, 12-15 and 20-22 of 42. Having fully investigated these sites, Staff sent notice of the proposed amendments to the affected landowners and published notice in local newspapers and in the ENB. Legislative public hearings were held on May 10, 2001 and May 11, 2001 and a public comment period was provided through June 22, 2001. Upon review of Staff's findings and recommendations relative to this matter, the Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendments, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that Wetlands BL-4, DL-18, DL-19, T-8, WE-35 and WW-40 be added as Class I wetlands; that Wetland WW-42 be added as a Class II wetland; that a boundary adjustment be made to combine wetlands H-24 and H-25 on Maps 7 and 8 of 42 and to rename the resulting wetland H-24; and that the classification of Wetland H-24 be revised to Class I, effective November 28, 2001. A copy of the amended final maps will be filed with the office of the clerk of each affected local government and in the Department's Region 4 office.

Greene County - Subsequent to the promulgation of the final Freshwater Wetlands Maps for Greene County on February 4, 1987, DEC Region 4 Staff found several inaccuracies affecting Maps 7, 8 and 15 of 21. Having fully investigated these sites, Staff sent notice of the proposed amendments to the affected landowners and published notice in local newspapers and in the ENB. Legislative public hearings were held on May 10, 2001 and May 11, 2001 and a public comment period was provided through June 22, 2001. Upon review of Staff's findings and recommendations relative to this matter, the Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendments, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that Wetland HT-7 be added as a Class II wetland and that a boundary adjustment be made to Wetland A-5 and that its classification be revised to Class I, effective November 28, 2001. A copy of the amended final maps will be filed with the office of the clerk of each affected local government and in the Department's Region 4 office.

Schoharie County - Subsequent to the promulgation of the final Freshwater Wetlands Maps for Schoharie County on December 18, 1985, DEC Region 4 Staff found an inaccuracy affecting Map 18 of 22. Having fully investigated this site, Staff sent notice of the proposed amendment to the affected landowners and published notice in local newspapers and in the ENB. Legislative public hearings were held on May 10, 2001 and May 11, 2001 and a public comment period was provided through June 22, 2001. Upon review of Staff's findings and recommendations relative to this matter, the Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendments, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that GI-22 be added as a Class II wetland to Map 18 of 22 for Schoharie County, effective November 28, 2001. A copy of the amended final maps will be filed with the office of the clerk of each affected local government and in the Department's Region 4 office.
