Amendments of the Final Freshwater Wetlands Maps

Sullivan County - Subsequent to the promulgation of the final Freshwater Wetlands Maps for Sullivan County on August 13, 1986, DEC Region 3 Staff found an inaccuracy affecting Map 6 of 32. Having fully investigated this site, Staff sent notice of the proposed amendment to the affected landowners and published notice in local newspapers and in the ENB. Legislative public hearings were held on May 10, 2001 and May 11, 2001 and a public comment period was provided through June 22, 2001. Upon review of Staff's findings and recommendations relative to this matter, the Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendments, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that WI-70 be added as a Class I wetland to Map 6 of 32 for Sullivan County, effective November 28, 2001. A copy of the amended final maps will be filed with the office of the clerk of each affected local government and in the Department's Region 3 office.

Ulster County - Subsequent to the promulgation of the final Freshwater Wetlands Maps for Ulster County on August 25, 1988, DEC Region 3 Staff found several inaccuracies affecting Maps 11 and 18 of 37. Having fully investigated these sites, Staff sent notice of the proposed amendments to the affected landowners and published notice in local newspapers and in the ENB. Legislative public hearings were held on May 10, 2001 and May 11, 2001 and a public comment period was provided through June 22, 2001. Upon review of Staff's findings and recommendations relative to this matter, the Commissioner was satisfied that Staff appropriately responded to all oral and written comments on the proposed amendments, and that Staff's recommendations were consistent with the requirements of the Freshwater Wetlands Act and supported by the record. The Commissioner ordered that BE-5 and AS-33 be added as Class I wetlands to Map 11 and 18 of 37; that a boundary adjustment be made to combine wetlands AS-20 and AS-21 and to rename the resulting wetland AS-20 on Map18 of 37; and that the classification of Wetland AS-20 be revised to Class I, effective November 28, 2001. A copy of the amended final maps will be filed with the office of the clerk of each affected local government and in the Department's Region 3 office.

Negative Declaration

Westchester County - The Village of Irvington Planning Board, as lead agency, has determined that the proposed Bridge Street Properties will not have a significant adverse environmental impact. The action involves Site Development Plan approval for a 24,000 sq. ft., three-story commercial building to be constructed on property to the south of West Main Street, with parking to be provided on the applicant's property located both north and south of West Main Street. The project is located at 2 West Main Street, Village of Irvington.

Positive Declaration and Public Scoping Session

Sullivan County - The Town of Thompson Planning Board, as lead agency, has determined that the proposed Akwesasne Mohawk Mountain Resort and Casino may have a significant adverse environmental impact and a Draft EIS must be prepared. A public scoping session will be held on December 12, 2001 at 7:30 p.m. at Town Hall, Town of Thompson, 4052 Route 42, Ames Plaza, Monticello, NY. The action involves the site plan and subdivision review for the development of a resort hotel and casino. The project is located along Anawana Lake at Anawana Lake Road in the Town of Thompson at the site of Kutsher's Sports Academy.

Notice of Acceptance of Draft EIS

Orange County - The Montgomery Planning Board, as lead agency, has accepted a Draft EIS on the proposed Fox Hill Bruderhof Communities in NY, Inc. The action involves a self-contained residential development with community facilities, agriculture and industry on 263 of its 411 acres of property located on Coleman Road east of Route 208 in the Town of Montgomery. It seeks a zoning amendment and an amendment to the Town of Montgomery Plan in order to utilize a 10-acre portion of the site for industrial purposes including warehousing. Of the 263 acres which are part of the planned development, 180 acres north of Coleman Road and on both sides of the residential enclave are proposed to remain in open space and agricultural use. The residential portion of the community is to be composed of 125 residences located in 12 dwelling structures with ancillary community buildings. The ancillary buildings and structures proposed include a dining hall, generator (utility) building, garage with fueling services, cemetery, daycare, school, recreation (both indoor and outdoor) and general community services. 328 acres are proposed to remain as agricultural open space. Multiple actions are required as part of the proposal including, but not limited to, the subdivision of two lots; rezoning preceded by amendment to Town Plan; approval of a cluster development for the residential component of the community based on a conventional subdivision of 125 or more lots; all other municipal planning and zoning approvals including all special exception use permits, where necessary, and site plan approval for the overall plan, extension of water and sewer services; SPDES permits for sewer and drainage; and access to a state highway. Depending on the alternative chosen, the type and number of approvals would differ. During the continuing reviews, additional needed approvals may be revealed and will be noted. The project is located on Coleman Road and Route 208, Town of Montgomery.

Notice of Acceptance of Draft EIS and Public Hearing

Westchester County - The Town of Greenburgh Town Board, as lead agency, has accepted a Draft EIS on the proposed Fortress Bible Church and School. Public hearings on the Draft Environmental Impact Statement will be held on Wednesday, December 12, 2001, at 7:15 pm and on Wednesday, January 9, 2002 at 7:15 pm at the Town Board meetings to be held at Town Hall, 320 Tarrytown Road, Elmsford, New York 10523. Comments on the Draft Environmental Impact Statement are requested and will be accepted by the Town Board c/o the Town Clerk, Town of Greenburgh, 320 Tarrytown Road, Elmsford, New York 10523, until Monday, January 21, 2002. The proposal includes the development of an approximately 15,000 square foot Fortress Bible Church and School and other site improvements on a 6.53-acre parcel. The project is located north of Dobbs Ferry Road, east of the Sprain Brook Parkway and west of Pomander Drive, in the Town of Greenburgh.

Westchester County - The City of New Rochelle, as lead agency, has accepted a Draft EIS on the proposed Construction of Two New Dormitory Buildings. A public hearing on the Draft EIS will be held on December 11, 2001 at 8:00 p.m. in City Hall, 515 North Avenue, New Rochelle, NY. Comments on the Draft EIS are requested and will be accepted by the contact person up to ten days following the close of the public hearing. The action involves (a) amend the site-specific restrictions and conditions imposed by ordinance No. 228 upon Lot 158 in Block 1556, in Section 5, and (b) to change the zoning classification of former lots 32 and 34 in Block 1431 in Section 5 from its present C-1 designation for the construction of two six-story dormitory buildings to house 358 students. The project is located at the southwest corner of Summit Avenue and North Avenue in the City of New Rochelle.

Notice of Acceptance of Draft Generic EIS and Public Hearing

Westchester County - The Westchester County Board of Health, as lead agency, has accepted a Draft Generic EIS on the proposed Comprehensive Mosquito-borne Disease Surveillance and Control Plan. A public hearing on the Draft Generic EIS will be held on December 13, 2001 at 2:00 - 4:00 p.m. and 7:00 - 9:00 p.m. at the Westchester County Center, Tarrytown Road, White Plains. The action involves adoption and implementation of a comprehensive plan to control the spread of mosquito-borne diseases in Westchester County. The plan includes: vector, vertebrate host and human surveillance; medical provider and general public education and outreach; mosquito control, if warranted; and research and program evaluation. The project is located county-wide.
