Fulton County - Adirondack Park Agency Project 2000-299, Scott Baldwin [d/b/a/ Northville Septic Service]

NOTICE IS HEREBY GIVEN pursuant to Section 809 of the Adirondack Park Agency Act (Article 27 of the Executive Law) and 9 NYCRR Part 580 that the Adirondack Park Agency will commence a public hearing on December 6, 2001, in the town offices of the Town of Northampton, Fulton County on an application filed by Scott Baldwin d/b/a/ Northville Septic Service. The applicant seeks Agency approval for a waste disposal area on land designated as Tax Map Parcel 18-2-1.111, accessed from Maple Grove Road in the Town of Northampton. Waste disposal in this area is a Class A regional project.

The project site is a 71-acre parcel of land classified as Rural Use by the Official Adirondack Park Land Use and Development Plan Map. The applicant proposes to use approximately 15 acres of the site to dispose 500,000 gallons of septage collected annually from residential septic tanks and holding tanks. Septage will be incorporated into the soil by subsurface injection and will be stored in two lined lagoons during the winter and rainfall. Disposal will take place year-round on weekdays.

Potential project impacts anticipated to be considered at the hearing include (1) odor, (2) ground water and surface water quality, (3) stormwater/septage run-off, (4) compatibility with adjacent residences, and (5) alternative disposal methods.

The applicant earlier held an Agency permit authorizing the disposal of septage by storage in unlined lagoons on the same site; that permit expired on August 9, 2000.

The hearing will commence at 10 a.m. with an informal public comment session during which any interested person may speak. Written comments or questions may be submitted to the Agency prior to and during the hearing. All written comments submitted to date will be offered as hearing exhibits. Any person (other than landowners within 500 feet of the project site and certain government entities who are already entitled to party status) desiring to become a formal party to the hearing in order to present evidence and cross-examine witnesses must comply with the procedure set forth in Section 580.7 of Agency regulations by filing a proper petition with the Agency. Persons entitled to party status waive that entitlement if they fail to attend the hearing, except for good cause shown.

Pursuant to Section 301(2) of the State Administrative Procedure Act, interpreter services will be made available to deaf persons at no charge upon written request to the Agency within a reasonable time prior to the hearing.

The informal hearing will likely be followed by a pre-hearing (issues) conference. Participants will include the applicant, Agency staff members, and any other persons and state agencies which are, or which seek to be, parties to the hearing. The parties may discuss hearing procedures, the issues to be considered at the hearing, proposed exhibits and witnesses, and petitions for party status. This conference is also open to the public.

The project application file is available for review and copying by the public during normal business hours at Agency office on Route 86 in Ray Brook, in accordance with the Freedom of Information Law. A copy of the application can also be reviewed at the office of the Town Clerk, Town of Northampton. For further information, contact the Project Review Officer, John L. Project Description: Brief Project Description: The project involves the construction of a 72-unit 10,800 square foot commercial storage building on the south side of County Road 11. The storage facility is proposed to be accessible for use 365 days per year from 7:00 a.m. to 7:00 p.m.

Project Name: Douglas A. West

Project Description: The action involves a new commercial sand and gravel extraction at two locations on the project site. On an 8 acre site, the applicant proposes to remove previously-screened stone, re-screen the stone as to size, and to crush all rock greater than 4 inches in size. On a 4.9-acre site, the applicant proposes to excavate sand and gravel to provide sand to the Town of Wilmington Highway Department and sell remaining sand and gravel. Sand and gravel will be screened on-site. An average of 5,000 cu. yds. to a maximum of 15,000 cu. yds. of crushed stone and an average of 2,000 cu. yds. to a maximum of 42,000 cu. yds. will be removed yearly during the five-year life of mine of these two extractions. Hours of operation are 7:00 AM to 6:00 PM weekdays and 8:00 AM to 5:00 PM on Saturdays during the fall, winter and spring months for sand extraction and stone crushing and similar hours for sand extraction during the summer months.

Project Name: Freeman

Location: NYS Route 28/30, Town of Long Lake

Project Description: The project consists of an after-the-fact subdivision of 9.9 acres on the shoreline of Long Lake located in Hamlet & Moderate Intensity Use land use areas involving wetlands and resulting in the creation of two substandard-size, non-building lots, and the construction of two single-family dwellings. The dwellings are served by individual on-site wastewater treatment system and municipal water supply. The development meets all shoreline setback requirements. No filling or disturbance of wetlands have occurred or is proposed.


Notice of Acceptance of Draft EIS and Public Hearing

Clinton County - Clinton County Legislature, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Clinton County Landfill Long-Term Development Plan. A public hearing on the Draft EIS will be held on December 6, 2001 at 7:00 p.m. at the Morrisonville Elementary School, Sand Road, Morrisonville, New York. The action involves the long term development of the Clinton County Municipal Solid Waste Landfill in order to ensure that the long-term disposal needs of the County are met. The proposed action includes revisions to the Landfill Development Plan, revisions to the Lease Agreement between Casella Waste Systems, Inc. and Clinton County, a modification to the current 6NYCRR Part 360 Solid Waste permit, and modification of the Clinton County Comprehensive Solid Waste Management Plan. The project is located on State Route 20 in the Village of Midget, 2.4 miles east of the intersection of Route 20 and County Route 394; or in the Town of West Watson in a field adjacent to the north bank of Widget Creek, 265 feet downstream of the County Route 451 bridge.
