Project Description:

The project proposed by the Town of Hume is the taking of a supplementary supply of water through a new interconnection with the Town of Caneadea. The interconnection of two existing water supply systems in the Town of Hume (Town of Hume Water District No. 1) and in the Town of Caneadea (Houghton Water District) will provide a backup source for each municipality. The interconnection will provide for a water supply system with a combined capacity of 1.03 mgd, a combined average daily demand of 0.53 mgd, and a combined storage of 1.34 million gallons. The new interconnected system will operate according to the terms of an Intermunicipal Memorandum of Understanding signed by both Town Supervisors in 2001. Required construction will consist of the installation of about 13,000 linear feet of 12"diameter water main, primarily within the right-of way of New York State Route 19, and two chlorination treatment facilities, one at each end of the transmission main. The watermain will cross four unnamed tributaries(class C waters) of the Genesee River and the adjacent area of regulated freshwater wetland HT- 10 (class I).

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The application is for a 2 acre addition to the Takacs Gravel Pit, currently permitted for 4.5 acres. The addition will increase the life of the mine by an estimated 15 years. No other changes in the mining plan and reclamation plan (wildlife habitat and open space) are proposed. The mine site is aproximately 1,600 feet north of NYS Route 39 and 2,700 feet west of Canpbell Road. The expansion area is contiguous with the northeast corner of the current mine boundary.

Project Description:

CH Resources proposes to modify their existing permit to allow combustion of up to a maximum of 10%, by weight, tire derived fuel in combination with coal and/or petroleum coke for the facility's boiler. The project would remove from the State's solid waste stream up to 12,400 tires per day. Stack emission testing conducted on tire derived fuel mixed with coal indicated compliance with all existing emission limits in the existing permit. The CH Resources facility generates electric power for commercial sale and is located at 5300 Frontier Avenue in the City of Niagara Falls, Niagara County. This change would be a minor modification of the existing Prevention of Significant Deterioration (PSD) determination and Title V permit. The Department has prepared a Draft permit and made a tentative determination to approve this application for a modification of an existing permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments for facility wide air emissions. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the regional office. Written comments may be made within the 30 day period ending on the last filing date indicated in this notice. The Department may modify the draft permit based on significant or important information raised during the comment period. The Department may also schedule a public hearing based upon an evaluation of the nature and scope of any written comments raised. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the U.S. Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. Following the 30 day comment period, the EPA will have an additional 45 days to review the draft or modified draft permit. If the EPA does not raise any objection in that time, the Department may then issue the final draft permit as the Title V Permit.

The applicant proposes to protect approximately 400 linear feet of eroding stream bank along the west side of Cayuga Creek. Gravel will be skimmed from a bar on the east side to grade and shape the eroded stream bank and provide a proper bedding material for the placement of rock riprap.
