Project Description:

Xerox Corporation (Xerox) has submitted an application for an interim Air State Facility Permit approval to construct and operate a new Emission Unit (C-0NC07) in Building 208 at its Xerox - Joseph C. Wilson Center for Technology facility located at 800 Phillips Road in the Town of Webster, Monroe County. This new emission unit will emit air contaminants associated with a new non-compliant solvent coating process that will use existing equipment that currently is used for an exempt powder coating operation. Associated with this application, Xerox has also submitted a request for a variance from the Reasonable Available Control Technology ( RACT ) requirements for Volatile Organic Compounds (VOC) found in 6 NYCRR Part 228 [ Surface Coating Processes, Subdivision 228.3(e)]. In support of the request for RACT variance, Xerox has submitted a VOC RACT Evaluation report. The report concluded that process change, reformulation, and add-on control alternatives for reducing VOC emissions were found to be technically and/or economically not feasible. Based on a review of the RACT Evaluation report, the Department has decided to approve the RACT variance request, as well as to approve the permit for construction and operation of Emission Unit C-0NC07. A draft permit will be prepared which includes Special Permit Conditions that limit the VOC emissions from Emission Unit C-0NC07 to a maximum of 1.62 Tons Per Year (TPY), on a rolling 12 month basis. 1.62 TPY is the maximum annual VOC emissions for Emission Unit C-0NC07 that was evaluated in the VOC RACT Evaluation Report. The draft permit also requires that Xerox maintain records of VOC emissions from Emission Unit C-0NC07 demonstrate compliance with the rolling twelve month emission limit.This RACT variance approval and the Air State Facility Permit approval for this emission unit will subsequently be processed through a federal review process as a revision of the State Implementation Plan. The Air State Facility permit for this emission unit will be issued at the conclusion of the comment period noted below, unless comments are received which raise significant issues that have not been addressed. Copies of the application and draft special permit conditions can be reviewed at the NYSDEC Region 8 office.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Dec 14 2001.
