Pursuant to Environmental Conservation Law Section11-0903(7) the Department of Environmental Conservation hereby gives notice of the following:

Notice is hereby given that the Department of Environmental Conservation is reviewing the application of Philip and Patricia Phillips Marco of Peconic, New York to obtain an OFF-BOTTOM CULTURE PERMIT, including a TEMPORARY MARINE AREA USE ASSIGNMENT which would allow the placement and operation of an off-bottom culture of shellfish grow-out activity on public underwater lands in Hog Neck Bay approximately 1,250 feet from shore, easterly of Nassau Point. The proposed off-bottom culture assignment site is a circular area with a radius of 250 feet having a center point located in Hog Neck Bay at Latitude North 40@ 59' 37" and Longitude West 72@ 25' 56". The proposed off-bottom culture system would involve the deployment of up to 200 steel and plastic mesh shellfish cages each measuring 6'long x 3'wide x 3'high at a depth of no less than 18 feet from mean low water. The shellfish species to be contained shall be Eastern oyster (Crassostrea virginica), hard clam (Mercenaria mercenaria), and bay scallop (Argopecten irradians). There are no existing Temporary Marine Area Use Assignments within 1 mile of the proposed Off-Bottom Culture/Assignment Area. Initial review of the subject application does not identify any adverse or unreasonable effects on the viability, maintenance or use of local marine resources.

Public Comment: The subject application may be reviewed at the address given below, and specific comments on the requested permit, including the proposed Temporary Marine Area Use Assignment, or a request to become a party-in-interest if a public hearing is held, must be submitted in writing to the contact person named below no later than November 9, 2001. The Department of Environmental Conservation as lead agency has made an initial determination that this action will not have a significant effect on the environment. Negative Declaration

Nassau County - The Town of North Hempstead Board of Zoning Appeals, as lead agency, has determined that the proposed i.park Lake Success will not have a significant adverse environmental impact. The action involves the renovation of an existing industrial 1,196,473 sq. ft. building to include 584,500 sq. ft. of office space and 586,600 sq. ft. of industrial/ telecommunication space. The project includes 4 buildings in which the interiors and infrastructure will be upgraded and partitioned to house multiple users and provide a telecom and fiber network. Exterior changes include 40,000 sf of additional landscaping and complete repaving of parking, including new landscape islands. The exteriors of the existing buildings will be refurbished, cleaned, and pointed. New energy-efficient windows will be installed, and new entrances will be provided to tenant spaces. Additional interior amenities will be provided, and the entire facility will be made ADA compliant. The project is located at 1111 Marcus Avenue, Lake Success, Town of North Hempstead.

Nassau County - The Town of North Hempstead, as lead agency, has determined that the proposed North Shore Hospital will not have a significant adverse environmental impact. The action involves construction of a four (4) story, 52,300 s.f. expansion to the Boas Marks Research Bldg. At the North Shore Univ. Hospital’s main campus. The project is located at 300 Community Drive, Manhasset.

Nassau County - The Town of North Hempstead, as lead agency, has determined that the proposed Town – Wide Trailway will not have a significant adverse environmental impact. The action involves the Feasibility study, planning and design, and construction of a town-wide trailway of approximately 22 miles. The trail will link existing resources such as parks, ponds, waterways and open spaces. The feasibility study and design reports shall identify the specific location, use and design of trailway. Construction of the trail throughout the Town will utilize existing sidewalks and trails, where possible, and create new trails where necessary to create a continuous trail that offers access to shorelines, open spaces, waterways parks and preserves.

Suffolk County - The Town of Huntington Planning Board, as lead agency, has determined that the proposed Brittany Estates will not have a significant adverse environmental impact. The action involves the re-subdivision of three parcels totaling 18.06 acres into fourteen lots to allow the construction of single-family homes and required improvements. Proposed improvements include roads, curbing, public water connection and an enlargement of the existing recharge basin on Mountain View DRive and associated modification of other existing drainage facilities. The project is located on the east side of Wayne Court, 675 feet south of Mountain View Drive and running east to Bread and Cheese Hollow Road to a point slightly north of the intersection of Valleyview Drive in Fort Salonga, Town of Huntington.

Positive Declaration

Suffolk County - The Town of Southampton Town Board, as lead agency, has determined that the proposed Westhampton Dragstrip Planned Development Districts (RPDD) may have a significant adverse environmental impact and a Draft EIS must be prepared. The action involves.a proposed code amendment to rezone land from CR200 residential Zoning district to a Residential Planned Development District (RPDD) upon its own motion covering the Westhampton Drag Strip. The RPDD encompasses up to 230 mixed residential senior citizen housing units, clubhouse and various recreational amenities. The project is located on Old Country Road between Summit Blvd. and Fifth Avenue (SCTM No. 900-329-1-12.1), Westhampton, Town of Southampton.

Notice of Acceptance of Draft EIS and Public Hearing

Suffolk County - The Town of Riverhead Planning Board, as lead agency, has accepted a Draft EIS on the proposed North Fork Preserve, Inc. A public hearing will be held on November 15, 2001 at 3:00 p.m. at Riverhead Town Hall, Meeting Room, 200 Howell Avenue, Riverhead. Comments on the Draft EIS are requested and will be accepted by the contact person until November 26, 2001. The action involves the subdivision of a 133 acre parcel zoned Residence C and Agriculture A 57 single and separate lots and place infrastructure for the construction of detached dwellings. The project is located on the south side of Sound Shore Road, approximately 2,000 ft. west of Pier Avenue, Jamesport (Northville), Riverhead.
