Project Description:

     Broome County has submitted permit applications to expand the existing Nanticoke Landfill. The 99 acre landfill expansion with a maximum height of 125' above existing ground, would be conducted on 539 acres. As proposed, the landfill expansion would provide Broome County with approximately 52 years of site life (at the current rate of 207,000 cubic yards per year of municipal solid waste and 8,000 tons per year of construction and demolition debris. The landfill expansion is proposed to be developed in eight stages with individual cells ranging from 5 to 17 acres.

     Construction of the landfill will impact less than 2 acres of United States Army Corps of Engineers jurisdictional freshwater wetland. During the early phases of the landfill expansion (approximately first 10 years), approximately 0.5 acres of freshwater wetlands were impacted. To compensate for this loss, the County has proposed to create approximately 1.5 acres of additional freshwater wetland adjacent to existing freshwater wetland. Future mitigation for the remaining freshwater wetland losses will be proposed at a later date.

     In addition to the solid waste regulations, the existing landfill and proposed expansion are regulated by the Department's Air Title V program.

     The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act, and has made a tentative decision to approve this permit to Broome County, Government Plaza, Box 1766, Binghamton, NY 13902

     The Facility receives municipal and private waste for disposal. Broome Energy Resources, LLC, and independent company, installed a landfill gas collection system and operates a landfill gas to energy facility that consists of two engine/generators and a flare to burn the collected landfill gas. A second flare to burn landfill gas is part of the propsed landfill expansion. The Facility also has weigh station and miscellaneous equipment to move, compact and cover the waste materials.

     The design capacity of the landfill exceeds the applicability size threshold (2.5 million megagram and 2.5 million cubic meters) of the NYS Emission Guidelines for MSW Landfill Emissions and 40 CFR 60, subpart Cc, Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills. Therefore, a Title V operating permit is required. This facility is also subject to, and must comply with 40 CFR 60, subpart WWW, Standards of Performance for Municipal Solid Waste Landfills.

     In accordance with 6 NYCRR Parts 621.6(d)(9) and 201-6.1(c), the Administrator of the

US EPA has authority to bar issuance of a Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

     The application, draft permit and supporting materials are available for review during normal business hours at the DEC Region 7 sub-office at 1285 Fisher Avenue, Cortland, NY 13045. Comments of support of objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

State Environmental Quality Review (SEQR) Determination: A draft environmental impact statement has been prepared on this project and is on file.
SEQR Lead Agency: Broome County
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Nov 26 2001.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this permit for the existing Felix Schoeller Technical Papers, Inc. production facility, located at 179 County Route 2A, Pulaski, NY. This facility produces specialty sheet paper products for various applications. This permit contains VOC RACT variance provisions related to compliance with 6NYCRR Part 228.3.

The draft permit and application are available for public review at the Region 7, Syracuse office. In accordance with 6NYCRR Parts 621.6(d)(9) and 201-6.1(c), the administrator of the US Environmental Protection Agency has authority to bar issuance of a Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
