Project Description:

The applicant, Wawayanda Energy, proposes to construct and operate two General Electric 7FB combustion turbines (CTGs), heat recovery steam generators (HRSGs) and one steam turbine generators and associated balance-of-plant systems and facilities. The fuel will be natural gas. The nominal electric generating capacity of the proposed Facility will be approximately 540 megawatts (MW). The Project will employ an Air Cooled Condenser (ACC) and will require on average 244,000 GPD. Cooling water will be supplied by the City of Middletown's publicly owned treatment works and potable water (5,000 gpd) will be supplied the City of Middletown through Wawayanda Water and Sewer District No. 1. The project is located off Dolsontown Road, approximately 2,000 feet east of the intersection with 17M, in the Town of Wawayanda, Orange County.

Pursuant to 6NYCRR Part 201, Wawayanda Energy has opted to obtain a preconstruction permit and certificate to operate authorizing the construction and operation of the proposed Ramapo facility, pursuant to 6 NYCRR Subpart 201-6.1, prior to obtaining a Title V permit. The Department has made a tentative determination to approve this air application and a draft permit is available for review. Wawayanda Energy has also applied for a Prevention of Significant Deterioration pre-construction permit pursuant to 40 CFR 52.21. A copy of the entire PSD notice can be found at www.dec.state.ny.us/website/ohms/notices/wawayandapsd.htm.

Pursuant to the Phase II requirements of Title IV of the Clean Air Act and 40 CFR 72.6(a)(3), the Staff has also reviewed Wawayanda Energy's acid rain permit application included in the Title V application and has found it approvable.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative determination to approve this application for a new SPDES permit for surface discharge from two outfalls with an average daily flow of 350 million gallons per day (MGD) at the East Delaware Tunnel Outlet (EDTO) located near the northern terminus of Rondout Reservoir (Class AA): Outfall No. 001 reflects the routine transfer of approximately 350 MGD of drinking water from Pepacton Reservoir to Rondout Reservoir as part of on-going drinking water supply operations for the City of New York; Outfall No. 01A is a proposed periodic discharge to the Rondout Reservoir of approximately 1100 gallons per day (GPD) of treated groundwater seepage pumped from an underground sump and an infrequent discharge from a stilling chamber. The project involves no new construction and is located at the NYCDEP's existing water supply facilities east of NYS Route 55A, approximately 2000 feet south of Sugarloaf Road in the Town of Neversink, Sullivan County. A draft permit is available for inspection and comment at the regional office.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
