Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application.

The Al Turi Landfill, Inc. owns and operates a municipal solid waste (MSW) landfill located in Goshen, Orange County. The facility is equipped with a landfill gas collection system which conveys landfill derived gas to the independently owned and operated Ameresco LFG-1 Inc. facility. The Al Turi landfill design capacity is 5.5 million megagrams with a maximum landfill gas emission rate of 753 Mg/yr.

The landfill gas collection system consists of approximately 112 vertical gas extraction wells and approximately 10 horizontal gas pipes spaced approximately 200 feet apart with a series of lateral and header pipes.

Emissions have been identified from the following sources: the landfill mass (collected) , the leachate storage lagoons, onsite gasoline, motor oil and fuel oil storage tanks, backup generator, building space heaters and fugitive from the landfill mass.

The current permitted landfill is approximately at 95% capacity. A Part 360 equivalent final cover system was substantially completed for the old landfill in the year 2000. A Part 360 final cover system has been installed on approximately 90% of the operational landfill. A comprehensive collection and control system, based on the November 1991 Master Plan, has been installed on approximately 90% of the landfill area. The facility is operating at 50 tons per week with a projected remaining operating life of less than 3 years. All vertical gas extraction wells supporting the completed and operating portion of the landfill are in place. A horizontal gas recovery lateral (final requirement) will be installed following final waste deposition in the active cell. This is required by the solid waste management permit.

The facility is subject to the requirements of 6 NYCRR Part 208 which includes: performance testing to demonstrate control efficiency of the control devices (Ameresco LFG-1 facility completed June 2001), monthly monitoring at each well head for pressure, nitrogen, oxygen and temperature, quarterly methane surface monitoring around the permitter of the collection area and along a pattern which traverses the landfill and monitor operations of the control devices (Ameresco LFG-1 facility). The facility is also required to submit annual compliance certification reports in accordance with 6 NYCRR Part 201-6.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specific and any Special Conditions included as part of this permit.

In accordance with 6 NYCRR part 621.5 (d) (9) and 201-6.5(c), the Administrator for the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6 NYCRR Part 201.

The Application and Draft Permit are available for review at the Regional Office of the New York State Department of Environmental Conservation.

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to replace the Brown Road bridge over NYS Route 17. The project involves the realignment of Brown Road to eliminate a reverse curve and the realignment of Weld Road to intersect Brown Road at ninety degrees. The project will result in the filling of approximately 0.13 acre of emergent wetlands. As mitigation, approximately 0.6 acre of wetlands will be created about 1 mile south of the project site at NYS Route 17 Exit 118A. The wetland mitigation area will be created by the removal of the eastbound exit ramp at Exit 118A.
