The Department has made a tentative determination to approve the addition of 0utfall 002 for the discharge of stormwater from driveways and parking areas to groundwater. The discharge is located within an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas within a three (3) mile radius of the applicant's facility: Hicksville, Bethpage, Plainview, South Farmingdale and Levittown Water Districts. The Slomin facility is located at 125 Lauren Lane in Hicksville, Town of Hempstead, Nassau County.

The applicant proposes to reconstruct a portion of Sumpwams Creek which was widened during the construction of the Village of Babylon Golf Course. The project encompasses a section of the creek approximately 900' long. In order to return the stream to its original 20' width, areas of the freshwater wetland will be filled with a total of 1000 cubic yards of clean fill. The resulting stream bottom will be dredged to increase the typical depth from 2' to 4' by removing 600 cubic yards of material including broken concrete, vegetation, and debris. The purpose of this project is to restore normal flow in the stream and to create an area adjacent to the stream which will promote the growth of wetland vegetation. The project is located in the Village of Babylon Golf Course in the Village of Babylon, Town of Babylon in Suffolk County, SCTM# 102-007-2-22.3 & 22.4.

The applicant proposes to remove the existing asphalt driveway and resurface a portion with gravel and the remainder with masonry pavers, install a 16' x 32' swimming pool, and extend the existing wood deck. Approximately 45 cubic yards of excavated soil from the pool installation will be graded along the south side of the pool deck to create a berm. The berm will be planted with native species and 18-20 boulders with a minimum weight of 500 lb. per stone will be randonly placed. The pool/deck are proposed within 20 ft. of the tidal wetland boundary and the applicant has requested a variance from the required 75 ft. structure setback. Existing lot coverage by impervious structures is 43% and the applicant proposes to reduce the lot coverage to 35%. The property is located at 65 Shore Court, Copiague, Town of Babylon, County of Suffolk, on Great South Bay.

Applicant proposes to reconfigure 154 existing boat slips including 6 commercial slips and add 26 new slips and associated floating docks and timber piles for a total of 180 boat slips within the marina basin. A total of 171 timber mooring piles will be required as compared to the existing 127. A total of 5,478 s.f. of floating dock space is currently utilized, the proposed floating docks will require 14,248 s.f. The property is located at Port Jefferson Harbor, Town of Brookhaven.

The applicant proposes to construct a single family dwelling, septic system, deck and driveway within 100' of Freshwater Wetland #NA11. The property is located at Cross Highway, Amagansett.

The applicant proposes to construct a 13' x 52' swimming pool with adjacent wood deck, shower, stone terraces, planters, and retaining walls on a lawn area. The accessory structures will cover approximately 1700 square feet. A single family dwelling currently exists on the property. The existing sanitary system is proposed to be removed and replaced at an increased distance from the wetlands. The proposed project is located within 100 feet of a regulated freshwater wetland at 105 Egypt Lane in the Village of East Hampton, town of East Hampton in Suffolk County, SCTM# 0301-004-10-005.002.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of Federal Clean Air Amendments and made a tentative determination to approve this application for the applicant's landfill facility. The sources subject to the Title V requirements consist of a closed and capped municipal solid waste landfill, a closed and capped ash monofill, and an active construction and demolition landfill.

The application, draft permit, and relevant supporting materials and regulations are available for review during normal business hours at the Regional DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. NYSDEC may schedule a public hearing cased upon an evaluation of the nature and scope of any written objection raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6 NYCRR part 621.6(d)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V facility permit if it determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The applicant proposes to construct a garage, additions to the dwelling, expand the existing gravel driveway and deck, upgrade the existing sanitary system, and plant beach grass. The dwelling expansion is proposed within 18 ft. of the tidal wetland boundary and the sanitary system within 40 ft. of the tidal wetland boundary. The applicant has requested a variance from the development restrictions which requires a 75 ft. setback from the tidal wetland boundary for structures and a 100 ft. setback for the sanitary system. The property is located at 50 Cold Spring Point Road, Southampton, County of Suffolk on Cold Spring Bay, SCTM No. 0900-155-01-060.
