Project Description:

The Department has prepared a draft permit and made a tentative determination to approve this application for a minor modification to the existing Title V facility permit for the applicant's pulp and paper manufacturing mill. The requested modification will allow the facility to burn up to 547 tons per day of bark/wood, rather than the currently permitted 425 tons per day, in a power boiler. Burning additional wood allows a corresponding decrease in the amount of fuel oil burned. Testing has demonstrated that emissions resulting from this change will remain below existing permit emission limits. The modification also allows for the injection of caustic material into the lime kiln air scrubber on an as needed basis to control total reduced sulfur(TRS) emissions rather than continuously. The modification also corrects an error on the TRS emissions monitoring for the recovery boiler to read "not to exceed 8ppm for more than 60 minutes per day" rather than the current 60 minutes per month. The application, draft permit and relevant materials are available for review at the Warrensburg DEC office. Comments of support or objection may be made by filing a written statement prior to the comment deadline. DEC may schedule a public hearing based upon the nature and scope of any issues raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c) the administrator of the USEPA has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Nov 2 2001.

Project Description:

The applicant proposes to construct a sediment retention basin adjacent to the current course of Hague Brook (Stream Class, AA-Special). The basin will have a total surface area of 9,800 square feet and an excavated volume of 3,500 cubic yards. At completion the Hague Brook will be diverted through the proposed basin. A precast concrete diversion structure will be placed on the upstream side of the basin. When the basin fills with sediment water will be diverted though the original channel so the sediment retention basin can be excavated in the dry.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
