Project Description:

The applicant proposes to rip-rap 310 linear feet of Nine Mile Creek, a class B, standards B(T) stream. Severe erosion has caused considerable loss of the applicant's property. A licensed professional engineer has developed an acceptable design for the project. Two to three ton stone will be keyed into the bank and bed of the stream. The site is located north of Whittaker Road and west of Glass Factory Road in the Town of Trenton, Oneida County.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Project Description:

The Department has drafted a permit modification pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments for the existing facility located at Corning, Inc. - Canton Plant, Canton, New York. The facility produces several types of high purity specialty glass. The primary SIC code for the facility is: 3229 - pressed and blown glass. The facility consists of Emission Units: U-00001, U-00002, U-00003, U-00004, U-00005 and U-00006. The facility is major for air emissions of particulates, PM-10, nitrogen oxides and hydrogen fluorides.

The glass forming furnaces included in emission unit U-00001, process 100 are capped out of Part 231-2 by limiting nitrogen oxide emissions to 80 tons per year. The glass forming furnaces included in emission unit U-00001, process 101 are subject to Part 231-2. The emission from this process are limited to 202 tons per year of nitrogen oxides. Corning as required under Part 231-2, obtained 233 tons per year of nitrogen oxides offsets. Emission units U-00005 and U-00006 are limited to 79,210 lbs/yr of nitrogen oxides and 79,500 lbs/yr of sulfur dioxide.

In accordance with 6NYCRR Part 621.5(d)(9) and 201-6.4(c), the Administrator of the Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the public comment period, the EPA will be provided a proposed permit and will have an additional 45 day period for review. If EPA does not raise any objection, the Department will issue the permit. The application and Draft Title V Facility Permit are available in the Region 6 NYS DEC office in Watertown, New York.

Project Description:

Applicant is proposing to construct and operate a facility that will manufacture oriented strandboard, a composite wood panel utilized in the building industry. The facility will operate 24 hours/day, 7 days/week and have a production capacity of 480 million square feet per year of 4' x 8' x 3/8" oriented strandboard unless the facility is required to operate less time or lower production rates to comply with facility emission caps. The facility will be located on a 70.85 acre parcel of land owned by the Ogdensburg Bridge and Port Authority on the north side of Wagner Road, approximately one mile southwest of its intersection with County Route 28. The facility will operate as a Synthetic Minor Air State Facility Permit. A "synthetic minor permit" requires the proposed facility to cap and limit emissions below the thresholds for a Title V permit under the Federal Clean Air Act. In requesting a synthetic minor permit, the applicant has agreed to keep its emissions below the Federal Title V thresholds.

The applicant has accepted permit conditions that make the facility a synthetic minor for emissions of Volatile Organic Compounds (VOC), Oxides of Nitrogen (NOx), Particulate Matter (PM & PM-10), Carbon Monoxide (CO), and Hazardous Air Pollutants (HAP). These permit conditions limit emission of the above pollutants to less than the major source applicability thresholds for Title V (6 NYCRR Part 201-6), New Source Review in Non-attainment Areas and Ozone Transport Regions (6 NYCRR Part 231-2), and Prevention of Significant Deterioration (40 CFR Part 52.21). The Department has reviewed this project to determine if it is subject to New York state New Source Review in Non-attainment Areas and Ozone Transport Regions codified at 6 NYCRR Part 231-2. NYS DEC has determined the project is not subject to this regulation. The Department has reviewed this project to determine if it is subject to Federal Prevention of Significant Deterioration regulations codified at 40 CFR Part 52.21. NYS DEC has determined the project is not subject to this regulation. The permit conditions will reduce emissions to a level below the significant source project thresholds of the above noted regulations. The Department has also reviewed this project to determine if it is subject to Reasonably Available Control Technology (RACT) regulations codified at 6 NYCRR Part 212.10 for VOC's and NOx and 6 NYCRR Part 227-2 for NOx. NYS DEC has determined the project is not subject to these regulations. The Department has also reviewed this project to determine if it is subject to Maximum Achievable Control Technologys for HAP's codified as 40 CFR 63 subpart QQQQ. NYS DEC has determined that the project is not subject to this regulation. The Department has also reviewed this project to determine if it is subject to Oxides of Nitrogen Standards for NOx codified as 40 CFR 60.44(b). NYS DEC has determined that the project is not subject to this regulation. The Department has also reviewed this project to determine if it is subject to the Title V Facility Permit regulations codified at 6 NYCRR part 201-6. NYS DEC has determined the project is not subject to this regulation. The permit conditions will reduce emissions to a level below the major stationary source thresholds of the above regulation. By accepting these state and federally enforceable permit conditions, the applicant will not be required to comply with these regulations. The applicant will be required to comply with all other applicable regulations and such limitations as contained in the draft permit.
