Project Description: The applicant proposes to operate a 20.26 acre Life of Mine, sand and gravel mine over a period of approximately 25 years, removing approximately 750,000 cubic yards of material. The site will be mined in 5 phases and reclamation will occur concurrently with mining. The operation will include the use of a portable crusher/screener. All topsoil will be stripped, stockpiled and used in the reclamation process. The site is located northwest of the intersection of NYS Route 203 and Pond Hill Road in the Town of Chatham, Columbia County. MLF #402-3-30-0730. This action was previously considered by the Department and resulted in a Mined Land Reclamation permit being issued on March 14, 2000. Subsequently, the matter was remanded by order of the Supreme Court (Columbia County). The applicant resubmitted its application on July 19, 2001. The Department has reassessed potential environmental impacts associated with the action as well as new information on the project that was brought to the attention of DEC subsequent to its issuance of the permit on March 14, 2000. All of the new information is now part of the complete application record. Such new information includes that which was provided to the Town of Chatham in connection with its consideration and approval of a special use permit for the action. Based upon its review, the Department has concluded that no significant adverse environmental impacts will result and an environmental impact statement will not be prepared. Although it is not required to do so, DEC is making available a draft permit for public review and comment. The draft permit is identical to the permit issued by the Department on March 14, 2000, except for the effective date and incorporation by reference of the latest Mined Land Use Plan (MLUP) and associated documents. The draft permit may be obtained from the contact person below. This Notice is being re-issued due to an admistrative error in connection with the August 7, 2001 Notice.

Project Description: The New York State Department of Environmental Conservation intends to modify Module VI of Schenectady International's 6 NYCRR Part 373 Hazardous Waste Permit. Module VI regulates the operational aspects of the hazardous waste incinerator located at the company's Rotterdam Junction facility. The company has conducted a series of trial burns and submitted a Health Risk Assessment Report based on the results of the stack tests that were conducted during the burns. The Department has tentatively determined that based upon the Health Risk Assessment Report, the heath risks of operating the incinerator are below the levels specified in US Environmental Protection Agency's guidance, and that the emissions from the incinerator meet Department standards. Therefore, the Department proposes to modify the permit to allow continued burning in accordance with the trial burn operating conditions, which are different from the conditions currently listed in the permit, with respect to the levels of constituents that can be contained in the wastes they are permitted to burn. |
