The Applicant, PSEG Power New York Inc, proposes to construct and operate the Bethlehem Energy Center, a gas-fired combined cycle power generation facility consisting of three General Electric 7 FA combustion turbines (CTGs), three heat recovery steam generators (HRSGs), one steam turbine generator (STG) and associated balance-of-plant systems and facilities. The primary fuel will be natural gas and the facility will have the capacity to use low (0.04 percent) sulfur distillate oil as a secondary fuel. The nominal electric generating capacity of the proposed facility will be approximately 750 megawatts (MW). The applicant proposes to withdraw an average of 4.72 million gallons per day (MGD) (8.53 MGD maximum) from the Hudson River via an intake structure located at the facility. Sanitary wastewater will be routed to the publicly owned treatment works at the Town of Bethlehem. Wastewater will be subject to appropriate monitoring and treatment and discharged to the Hudson River via existing outfalls. Stormwater will be discharged to the Hudson River via existing outfalls. The project is located on the site of an existing power generating facility, the Albany Steam Station, on State Route 144 in Glenmont, Town of Bethlehem, Albany County.

Pursuant to 6 NYCRR Part 201, the applicant has opted to obtain a preconstruction permit authorizing construction and operation of the proposed Bethlehem Energy facility pursuant to 6 NYCRR Subpart 201-6.1(b), prior to obtaining a Title V permit. The Department has made a tentative decision to approve this air application and a draft permit is available for review. In addition to the Part 201-6.1 preconstruction permit, DEC is concurrently issuing for public comment a Notice of Determination to Issue a Prevention of Significant Deterioration (PSD) permit pursuant to 40 CFR §§ 52.21 and 124. The Department has made a tentative determination to approve an application for a permit for the surface discharge of 3000gpd of treated leachate from the closed Town of Coeymans Landfill to an unnamed tributary of Hannacrois Creek. Discharge is proposed from the Town of Coeymans Landfill Leachate Treatment Facility on Jarvis Road in the Town of Coeymans, Albany County. A draft permit is available for review and comment at the Region 4 Office. SPDES #NY-024-2101

The Department has made a tentative determination to approve an application to modify an existing permit for discharge of 6,000 gpd of sanitary wastewater and varying amounts of noncontact cooling water to the Black Creek (Class A)/FWW V-19. The applicant plans to combine two separate sanitary treatment systems into one, and change the treatment process from sand filter bed and chlorination to trickling filters, sand filter and chlorination. The permit will also be modified to relax the limits for pH from 6.5 - 8.5 to 6.0 - 9.0 for the sanitary discharge (001), add a 90 degree F temperature limit for the non-contact cooling water discharges (002 & 003), and correct the permit to reflect that 2 non-contact cooling water discharges exist. The system will be located in the adjacent area of FWW # V-19 approximately 30' further from the wetland than the present system. The facility is located at 46 School Road in the Village of Vorheesville, and manufactures air handling systems.

The applicant proposes to repair the east and west banks of Dryden Brook that have been damaged from a logging operation. Repair consists of placing heavy stone rip rap along approximately 100 feet of streambank for stabilization. The project is located on Dryden Brook Road approximately 1/2 mile north of Walton Mountain Road.

The applicant proposes to add 17.6 acres to an existing 42 acre life of mine sand and gravel mine, for a total life of mine area of 59.6 acres, including the continued use of on-site processing. The site is located on Hemlock Road (County Route 458) in the Town of Milford, Otsego County. MLF #406-3-30-0046.

The applicant proposes to place fill in the adjacent area of Freshwater Wetland SD-4 to facilitate the reconstruction and expansion of an existing convenience store and fueling station. Encroachment of fill into the adjacent area will extend to within 15' of the wetland boundary. The project is located at State Routes 7 and 8 northwest of the Village of Sidney.

Applicant proposes to construct an Office/Commercial park requiring fill in 2 1/2 acres of Federally Regulated wetlands (USACOE #2000-00689-YN). Project site is located on Mannix Road, East Greenbush.
