Notice is hereby given that the Department of Environmental Conservation is reviewing the application of Whitecap Oyster Farms of New Suffolk, New York to obtain an OFF-BOTTOM CULTURE PERMIT, including a TEMPORARY MARINE AREA USE ASSIGNMENT which would allow the placement and operation of an off-bottom culture of shellfish grow-out activity on public underwater lands in Hog Neck Bay approximately 2,000 feet from shore, westerly of Cedar Beach Point. The proposed off-bottom culture assignment site is a circular area with a radius of 250 feet having a center point located in Hog Neck Bay at Latitude North 41@ 01' 32" and Longitude West 72@ 24' 41". The proposed off-bottom culture system would involve the deployment of up to 400 wire mesh and wood shellfish cages each measuring 6'long x 3'wide x 4'high and each containing up to 12 polymesh shellfish bags. The shellfish species to be contained shall be Eastern oyster (Crassostrea virginica), hard clam (Mercenaria mercenaria), blue mussel (Mytilus edulis), bay scallop (Argopecten irradians) and soft clam (Mya arenaria). There are no existing Temporary Marine Area Use Assignments within 1 mile of the proposed Off-Bottom Culture/Assignment Area. Initial review of the subject application does not identify any adverse or unreasonable effects on the viability, maintenance or use of local marine resources.
PUBLIC COMMENT: The subject application may be reviewed at the address given below, and specific comments on the requested permit, including the proposed Temporary Marine Area Use Assignment, or a request to become a party-in-interest if a public hearing is held, must be submitted in writing to the contact person named below no later than September 29, 2001. The Department of Environmental Conservation as lead agency has made an initial determination that this action will not have a significant effect on the environment. Suffolk County - The Planning Board of the Town of Brookhaven, as lead agency, has determined that the proposed Great Gardens II will not have a significant adverse environmental impact. The action involves approval for outdoor storage of bagged compost products, bulk storage of wood mulch, compost, and topsoil and nursery/landscape stock, in conjunction with existing site and operation on the adjacent property to the west. The project is located on the north side of Horseblock Road, west of Yaphank Avenue, Brookhaven.

|Notice of Acceptance of Draft EIS|
Suffolk County - The Town Board of the Town of Brookhaven, as lead agency, has accepted a Draft EIS on the proposed Town of Brookhaven Cell 6 Landfill Expansion. The action involves the expansion of the Town of Brookhaven’s Horseblock Road Landfill by constructing an additional fill area at this site. The lead agency has extended the time in which members of the public and interested and involved agencies may submit comment on the Draft Environmental Impact Statement prepared for this project. The comment period originally scheduled to close on August 20, 2001 has been extended to September 10, 2001. The project is located on Horseblock Road, Town of Brookhaven.

|Notice of Acceptance of Final EIS|
Suffolk County - The Town of Riverhead Town Board, as lead agency, has accepted a Final EIS on the proposed Special Permit and Site Plan of Headriver, LLC. The action involves the construction of a 135,200 sq. ft. lumberyard (home improvement superstore), a 45,000 sq. ft. office building and a 6,500 sq. ft. - 225 seat restaurant together with related site improvements upon a 21.2 acre parcel zoned Industrial A. The project is located north of Old Country Road (CR 58), at and just west of the northerly terminus of Kroemer Avenue, Riverhead.
