The applicant proposes to construct a 121' seawall, of concrete blocks, along the shoreline of his property on Owasco Lake. The property is located at 2810 Fire Lane #1, Route 38, Moravia at the southwest end of the lake.

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application for an existing facility (AES Jennison Station) located on Bainbridge Afton Road in Bainbridge, NY. The AES Jennison Station primarily consists of four traveling grate coal fired boilers rated at 281 mmBtu/hr heat input each connected to two electric generating units. Boilers #1 and #2 are connected to a common stack, and boilers #3 and #4 are connected to a common stack. Facility operations and permit limits will not change as a result of this Title V permit.

In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The application, draft permit and supporting materials are available for review during normal business hours at the DEC's office at 1285 Fisher Avenue, Cortland, N.Y. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.
