Project Description:

The applicant proposes to place two 6 foot diameter by 25 foot long culverts and associated fill within the bed and banks of Farrell Brook, a Class "D" non-protected stream, to facilitate construction of an access road to a proposed sand and gravel mine off LaPlante Road in the Towns of Altona and Beekmantown. Construction of the access road will also entail placing fill in approximately 5,100 square feet of wetlands not subject to regulation by the State. However, both the disturbance to the brook and wetland are subject to the permit jurisdiction of the U.S. Army Corps of Engineers (USACOE). As mitigation for the impact to the wetlands, the USACOE is requiring the applicant to construct 11,000 square feet of wetlands on another portion of the mine site property adjacent to Farrell Brook.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Aug 31 2001.

Project Description:

The purpose of the project is to restore and stabilize approximately 120 lineal feet of eroded White Creek stream bank which currently protects County Route 67 from flood damage during high flows. The applicant proposes to temporarily dewater low-flow to the gravel bar side of the channel; skim the gravel bar to low water level; utilize approximately 80 cubic yards of the bar gravel material to restore the embankment to a 2 to 1 (2:1) slope; line the toe of the new slope 6 feet high with heavy rock rip-rap; seed and mulch upper slope.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
