Project Description: The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application. Revere Smelting and Refining, located in the Town of Wallkill in Orange County, operates a secondary lead smelter which includes process equipment such as kilns and a reverbatory furnace. This facility is classified as a major source for Lead, Sulfur Dioxide and Oxides of Nitrogen and is subject to 40CFR 63X as well as 6NYCRR 212. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit. In accordance with 6NYCRR parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201. The application and Draft Permit are available for review at the Regional Office of the New York State Department of Environmental Conservation.

The project site is located in a private pond located on the south side of Otten Road, approximately 0.1 mile west of the intersection with Red Star Road. The proposed treatment includes the application of the herbicides Reward and Rodeo, and the algicide Cutrine Plus for the control of Eurasion water milfoil, coontail, elodea, and algae within the treatment area. The purpose of the project is to improve near shoreline conditions for swimming, fishing, and boating. The treatments would be carried out by a NYS Certified Pesticide Applicator in accordance with an Article 15/Part 329 Aquatic Pesticide permit from DEC. |

Refined Sugars Inc., is a sugar processing facility located at Yonkers. The facility is classified as a major source due to the quantity of Oxides of Nitrogen emitted annually. Air contamination sources at this facility comprise process and combustion sources. • Process Sources emit only particulate emissions which are controlled by centrifugal and fabric collectors. • Combustion sources include one internal combustion engine operating on diesel fuel, one boiler operated on natural gas or No.2 oil, and one co-generation system operated on natural gas or No.2 oil. Additional combustion sources at the facility include two furnaces which are exempt sources. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specific and any Special Conditions included as part of this permit. In accordance with 6 NYCRR part 621.5 (d) (9) and 201-6.5(c), the Administrator for the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6 NYCRR Part 201.
