The Department has a drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Amendments, and made a tentative determination to approve this application for the applicant's existing metal recycling facility.

In addition the facility operates a caterpillar diesel generator to supply the electrical power to run the emission control devices and other support equipment at the site. There is also a waukesha diesel generator installed as an emergency generator with operate s less than 499 hours per year.

The application, draft permit, and relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objections may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objection raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6 NYCRR part 621.6(D)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

The applicant proposes to construct a 289' gabion wall, a 371' x 8' asphalt bike path, and a 20' x 6' foot bridge along the western bank of the Carlls River in Village of Babylon parkland. The gabion wall is proposed to be located in a freshwater wetland and the bike path and foot bridge are to be located within 25' of the wetland boundary. The purpose of the gabion wall is to stabilize the stream bank. The purpose of the bike path and foot bridge is to provide recreational access to the area adjacent to the stream. The project is located in Village of Babylon parkland between Park Avenue and the Long Island Rail Road in the Village of Babylon, Town of Babylon in Suffolk County, SCTM# 102-006-1-24 & 102-009-1-28.

The facility consists of an automobile and scrap metal processing and recycling facility. The Gershow Recycling - Medford facility operates an automobile shredder powered by two natural gas engines rated at approximately 2560 horsepower each. The shredder employs cyclone separators and baghouse filters to limit the particulate emissions. In addition the facility operates a caterpillar diesel generator to supply the electrical power to run the emission control devices and other support equipment at the site. There are also a waukesha diesel generator installed as an emergency generator which operates less than 499 hours per year. A separate shredder is utilized to shred electrical motors and other copper bearing equipment to facilitate recovery of copper from scrap equipment.

The application, draft permit, and relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objections may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objection raised. The applicant, Brookhaven Energy, proposes to construct and operate a new gas-fired combined cycle power generation facility consisting of two combustion turbines (CTGs), two heat recovery steam generators (HRSGs), two steam turbine generators (STGs) and associated balance-of-plant systems and facilities. The fuel will be exclusively natural gas. The nominal electric generating capacity of the proposed Facility will be approximately 580 megawatts (MW). The facility will use an air-cooled condenser. The air emissions resulting from the turbines and generators will be vented through two 160 feet high exhaust stacks. Suffolk County Water Authority, a public water supply company, will provide the 0.0189 million gallons per day (MGD) on average required for the project. Process and sanitary wastewater will be routed to the Yaphank Sewer Treatment Plant. Wastewater that exceeds the appropriate discharge limits for quality or quantity will be trucked off site for proper disposal. The average stormwater discharge of 59,400 gallons per day (gpd) will be discharged to groundwater via a recharge basin. The project site is located southeast of the Sills Road interchange (exit 66) of the Long Island Expressway (LIE) in the Village of Yaphank, Town of Brookhaven, Suffolk County.

The Department has made a tentative decision to approve these permit applications. Pursuant to 6 NYCRR Part 201, Brookhaven Energy has opted to obtain a Title V permit authorizing construction and operation of the proposed Brookhaven Energy facility pursuant to 6 NYCRR Subpart 201-6.1. Comments of support or objections may be made by filing a written statement by the deadline date indicated. In accordance with 6 NYCRR Part 621.6(D)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

In addition to the Part 201-6.1 Title V draft permit, DEC is concurrently issuing for public comment a Notice of Determination to Issue Prevention of Significant Deterioration (PSD) conditions pursuant to 40 CFR §§ 52.21 and 124. The applicant proposes to construct a single family dwelling within the adjacent area of a NYS regulated Freshwater Wetland (#B-12). The dwelling is proposed to be constructed within 62 feet of the freshwater wetland, with clearing/ground disturbance activities proposed within 49 feet of the wetland. The project is located on the southeast corner of Dunton Avenue and Lake Street, East Patchogue, Town of Brookhaven, SCTM# 0200-982.9-1-36.

Applicant proposes to construct a 7500 sf steel building , a 400 sf one story office building, and associated parking . Site will be surrounded by a minimum 45' wide buffer area to remain natural. Project is located on West Main Sreet, Riverhead.

The applicant proposes to abandon an existing septic system and install a new septic system within 99 feet of regulated freshwater wetland #C-1. The septic system will be used for an existing residence. The site is located within Caleb Smith State Park on Route 25 in the Town of Smithtown, Suffolk County.

     The applicant proposes a 12-lot subdivision of 56.736 acres to construct 11 single family dwellings and retain one existing dwelling. The parcel includes 10.365 acres of tidal wetlands. Construction will be done for road improvements, extention of utilities, and other associated improvements. There will be no adverse impacts to archaeological and cultural resources ,agricultural land, soils / topography, groundwater. The project conforms with local land use zoning , the local waterfront revitalization program and has no impacts to the Stony Brook - Setauket outstanding natural coastal area. There are no significant impacts to stormwater drainage, significant coastal fish and wildlife habitat, surface waters ,transportation, vegetation, wildlife, visual resouces and open space associated with the project. A Negative Declaration has been prepared and is on file.

     The project is located on Harbor Rd. , opposite the terminus of Bacon Rd. ,St. James , N.Y.

Applicant proposes to demolish existing building and construct a 60' x 80' one story storage and office building. Project is located at the S/W/C/O Bay Avenue and Peconic Bay Blvd., Mattituck.

The applicant proposes to demolish an existing single family dwelling, and construct a new single family dwelling within the adjacent area of a NYS regulated Freshwater Wetland (#MT-2). The existing dwelling is located 76 feet from the freshwater wetland boundary, and the proposed dwelling will be located 71 feet from the freshwater wetland boundary. The applicant also proposes to reconstruct a 8.5 foot by 18 foot deck, 3 foot by 6 foot steps and 4 foot by 18 foot fixed dock. The project is located at 2635 Laurel Way, Mattituck, Town of Southold, SCTM# 1000-121-04-13.
