Project Description:

The Department has drafted a permit pursuant to Article 19(Air Pollution Control) of the NYS Environmental Conservation Law(ECL) and Title V of the Federal Clean Air Act Amendments and has made a tentative determination to approve the application for the applicants' existing pharmaceutical plant. The draft permit also incorporates requirements for proposed new sources, including a 98 mmBtu/hr natural gas/No. 2 oil fired boiler and 2 new tablet coating pans, and revises control requirements for an existing tablet coating system at the facility. The facility is a major source for emissions of Total Combined Hazardous Air Pollutants(HAP's) and individual HAP's. Emissions of Oxides of Nitrogen and Sulfur Dioxide are each capped at 99 tons per year and Volatile Organic Compounds are capped at 49 tons per year. The application, draft permit and revelant materials are available for review at the Warrensburg DEC office by contacting James Coutant, P.E. Comments of support or objection may be made by filing a written statement prior to the comment deadline. DEC may schedule a public hearing based upon the nature and scope of any issues raised. Hearing notices will contain instructions on filing for party status and submitting comments. In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c) the administrator of the USEPA has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes to construct a single-family residence in the adjacent area of Freshwater Wetland #R-11 (class II), and a 50 foot long dock for access to Ballston Lake. The house would be situated 55 feet from the wetland. The project is located on the south side of Outlet Road, approximately 1/4 mile west of Lake Road, at the north end of Ballston Lake.
