Project Description: The applicant proposes to modify an existing permit to excavate topsoil from a surface unconsolidated formation on a 9.9 acre mining facility. The modification involves expansion of the topsoil mine to 33.5 acres on a 60.7 acre parcel and also excavating sand below the water table. Two ponds totalling 5.6 acres with depths of approximately twenty and thirty feet respectively below existing grade, will be left as reclamation with the remainder in agricultural use. Some excavation will occur within the adjacent area of FWW RI-61. The mine, known as the Peck Road pit, is located east of Peck Road and south of the railroad tracks in the Town of Richland. |

Project Description: The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application for an existing facility (AES Cayuga Station) located at 228 Cayuga Drive in Lansing, NY. The AES Cayuga Station primarily consists of two 150 MW pulverized coal fired boilers with flue gas desulfurization for controlling SO2 emissions, and low NOx burners to control NOx emissions. Unit 1 is also equipped with Selective Catalytic Reduction for NOx control. Facility operations and permit limits will not change as a result of this Title V permit. In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201. The application, draft permit and supporting materials are available for review during normal business hours at the DEC's office at 1285 Fisher Avenue, Cortland, N.Y. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments. |
