Project Description:

The applicant proposes to replace the existing WJTN radio transmission tower with a new tower adjacent to the existing, in regulated Freshwater Wetland No. LW-10. The new tower height will be 204 feet and will be on a 6 ft square base with piling anchors driven 87 feet through the muck soil into bedrock and will also have 9 A.B. Chance (guy-wire) anchors. The ATU structure will occupy 5 sq ft, supported by 2 cement footers and elevated above the 100-year flood elevation. Approximately 45,239 sq ft of shrub swamp will be cleared and become wet meadow. Total area of cleared space (free of shrubs and trees) required for the new tower is 125,664 sq ft. (the cleared area for the existing tower is 80,425 sq ft). Maintenance of the required cleared area will be by mechanical means. The existing tower will be demolished and removed, except for the old tower base and portions of anchors below ground elevation. The site is north of Jones & Gifford Ave. at the Hallock St. Ext. intersection.

Project Description:

     The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 2,760 gallons per day of treated sanitary waste to the Lake Erie.

The Department has made a tentative determination to approve a new permit (SPDES # NY 0258504) for existing wet weather sanitary sewer overflow discharges from Outfall Nos. 001, 002 and 003 to the Buffalo River. The Draft Permit includes reporting requirements of overflow incidents and compliance schedules for plans and implementation of system assessment, flow monitoring, correction and maintenance and an abatement for the overflows. A Draft Permit is available for inspection and review at the DEC Region 9 Office in Buffalo and Allegany.

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the applicant's AES Somerset Generating Facility located on the shore of Lake Ontario. AES Somerset LLC, is a 691 megawatt (MW) bituminous coal fired electric generating facility originally permitted and operating under the 40 CFR 60 Subpart Da New Source Performance Standards for electric utility steam generating units for which construction commenced after September 18, 1978. Emission Unit S00001, consists of one boiler feeding steam to one turbine generator. Emission source B0001 is equipped with an electrostatic precipitator (ESP) to control particulate matter emissions. The precipitator is equipped with an energy management system that adjusts the power levels in the precipitator to maintain the desired opacity. Sulfur Dioxide emissions are controlled by a flue gas desulfurization (FGD) system capable of up to 95% removal efficiency. Nitrogen oxide emissions are controlled through the use of low-Nox burners installed on the boiler, good combustion practices, and a Selective Catalytic Reduction (SCR) unit installed in front of the ESP. Emissions from unit S00001 exit the main 625 foot stack, emission point 00001. Somerset has two oil fired auxiliary boilers, emission sources, each with a design heat input of 195 million Btu/hr. The auxiliary boilers are used to provide steam for a cold start of the main unit, for heating the buildings and for maintaining essential equipment in a hot condition when the main boiler is not operating. These boilers burn No. 2 fuel oil, sometimes mixed with kerosene, as their fuel with combustion gases exhausting at a 300 foot stack, emission point, 0001A. The application, draft permit, relevant supporting materials, and regulations are available for review during normal business hours at the regional office. Written comments may be made within the 30 day period ending on the last filing date indicated in this notice. The Department may modify the draft permit based on significant or important information raised during the comment period. The Department may also schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. A hearing notice would contain instructions on filing for party status and submitting comments. In accordance with 6 NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201. Following the 30 day comment period, the EPA will have an additional 45 days to review the draft or modified draft permit. If the EPA does not raise any objection in that time, the Department may then issue the final draft permit as the Title V Permit.
