Project Description:

This Department has received a request to modify an existing permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit at the facility located at Kraft Foods North America, Inc., 22 County Route 52, North Lawrence, NY 12967. Kraft produces cottage cheese and yogurt. On-site operations consist of ingredient mixing, milk curing and processing, cold storage, packaging and labeling. On-site emissions include three boilers at 12.55, 25.22 and 29.29 MBTU/HR (non-New Source Performance Standard) in emission unit 0-00001. Each boiler is fueled by natural gas or #6 fuel oil. This permit includes federally enforceable conditions to limit considered to "cap' sulfur dioxide emissions below the applicable threshold level set forth in 6NYCRR Part 201-6 for Title V and in 40 CFR Part 52.21 for Prevention of Significant Deterioration. The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Aug 24 2001.

Project Description:

     The Department of Environmental Conservation (DEC) has received an application to re-issue the following EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a tentative determination to re-issue this permit for a five-year period, maintaining the current effluent limitations and monitoring and reporting requirements. This permit involves the surface discharge of 13,500 gallons per day of treated sanitary waste to the Oswegatchie River.

     Additional information including the current permit, renewal applications, and supporting documentation may be obtained from or inspected at the NYSDEC central office in Albany. Substantive comments on the permit or requests for hearing or both must be submitted in writing to the contact person.
