The applicant proposes to develop and operate an eight acre sand and gravel mine within a 100 acre parcel on Cress Road in the Town of Phelps. The mine is intended to operate as a traditional surface extraction of sand and gravel. Mining is not proposed for below the local water table. Excavation will be done by mechanical equipment (a bulldozer, backhoe, and front end loader), standard for sand and gravel mining operations. Mining is proposed to remove approximately 100,000 cubic yards of aggregate sand and gravel over the operational life of the mine. Material will be stockpiled as unprocessed "run-of-bank", or processed with a portable screen having a maximum processing rate of less than 100 tons-per-hour. Final reclamation will restore the site to agricultural use with uniformly graded contours and will include the replacement of stockpiled topsoil, and re-seeding with an approved USDA SCS seed mixture. The reviewed life-of-mine area is 8 acres, four of which are for reclamation only. Application materials are available for public review and comment at the Regional Office of NYS DEC.

The applicant has previously applied for a permit modification for their wastewater discharge permit for which the NYSDEC issued a public notice on March 19,2001. It is now proposed to relax the fluoride permit limit for outfall 002 flowing to the Cohocton River on an interim basis while the applicant conducts a fluoride study consisting of a sampling and analysis program. The present fluoride limit is 3 milligrams per liter(mg/l) and the interim level is 12 mg/l. The final limit will be set after NYSDEC analysis of study results. The applicant Town of Urbana proposes to construct +/-400 L.F. of sheet steel break wall along the Keuka Lake shore line at the Keuka Lakefront Park The project site is east of Water Street, between William Street and Sheather Street. Construction of the wall is typical for driven steel structures of this type and will be done in conformance with the stamped engineered plans provided with the application. Project plans have been revised to minimize loss of near shore lake habitat.
