Project Description:

The Dutchess County Water and Wastewater Water Authority (DCWWA) has applied for a Freshwater Wetlands permit and a Water Supply Permit (WSA#10171) for its "Zone D Extension" project to acquire the existing Harbourd Hills Water District distribution system assets, to supply up to 137,500 gallons of water per day to 225 homes in the former Harbourd Hills service area and to serve an additional 175 previously unserviced customers all of which are in the Town of Hyde Park's existing Harbourd Hills Water District.

The DCWWA will acquire 17,200 linear feet of existing water distribution lines and construct a total of 16,000 linear feet of distribution lines and a transmission main to bring water from its existing 3.0 Million Gallon Per Day (MGD) water treatment plant which treats water from the Hudson River. Construction of portions of these water mains will occur in in roadbeds that are within the 100 foot wide adjacent area of three Freshwater Wetlands; HP-27, HP-30 and HP-38, however there will be no disturbance of the freshwater wetlands themselves. This installation activity will also disturb federally regulated wetlands however it is eligible for Nationwide Permit #12 (Utility Line Activities) which was issued by the U.S. Army Corps of Engineers.

This service area is located along NYS Route 9G, from approximately St. Andrews Road to Haviland Plaza , including portions of Creek Rd., Franklin Rd., Roosevelt Rd., Reynolds Blvd., Douglas Rd., Cynthia La., Carlyle Rd., Wright Ave., and Haviland Rd. in the Town of Hyde Park.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: Dutchess County Water & Wastewater Authority
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Aug 6 2001.

The applicant proposes to cross approximately 35 feet of wetland 100 foot adjacent area (wetland #L-24, Class: III) in conjunction with construction of a new residence. The location is on the north side of Route #35 approximately 1/2 mile east of the intersection with Boutonville Road.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
