The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and made a tentative determination to approve this application.

Great Eastern Color Lithographic Corporation maintains a printing facility in the Town of Poughkeepsie, Dutchess County, NY. The operations consist of three, multi-color web offset lithographic printing presses in order to produce magazines. Compliance with 6NYCRR Part 234 is achieved with the use of compliant fountain solutions. The facility has installed two afterburners to the two printing press emission points to control opacity and odors. The facility has a boiler that uses number four fuel oil and is less than 10 MMBTU/hr. The facility operations also include ultraviolet coating, hot melt glue application and paper baling.

Emissions of Volatile Organic Compounds are capped below major source thresholds of 50 tons per year with federally enforceable permit conditions.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

The Application and Draft Permit are available for review at the Regional Office of the New York State Department of Environmental Conservation.

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application.

The IBM East Fishkill facility is engaged in the development & manufacture of semiconductors for the computer & electronic industries. Emissions from the facility of Sulfur Dioxide, Oxides of Nitrogen (NOx) and Volatile Organic Compounds (VOCs) are above major source thresholds as defined by the Federal Clean Air Act and therefore required to obtain a Title V permit.

Emission Unit A00001 consists of eight (8) 72 MMBTU per hour natural gas fired boilers with low NOx burners utilizing #6 fuel oil as a backup and four (4) 32 MMBTU per hour natural gas fired boilers utilizing #2 fuel oil as a backup.

All tanks at the facility are exempt from 6NYCRR 229 requirements pursuant to 6NYCRR 229.1(f)(1) or 6NYCRR 229.1(f)(4) (horizontal petroleum or volatile organic liquid storage tanks). The vertical tanks have conservation vents and are pressurized with nitrogen to prevent emissions of volatile organic compounds to the outside atmosphere. The nitrogen pressure system is monitored periodically to ensure the system is working properly.

The manufacturing portion of the facility is subject to 6NYCRR 212 regulations. Three Eisenmann Regenerative Thermal Oxidizers (RTOs) are utilized for the destruction of emissions from process J1, Casting in Building 330. One Eisenmann Regenerative Thermal Oxidizer is used for the destruction of emissions from process J5, Sintering in Building 330. All three RTOs have continuous monitors and data recorders to document combustion and exhaust temperatures. The continuous monitors must be operated at all times when the associated process equipment is operating except during any quality assurance and routine maintenance activities. Each monitor must be operated according to a quality assurance program approved by the Department.

Three emission sources in Emission Unit C00001, Process J1 (Casting in Building 330), are subject to 6NYCRR 226. The Solvent Metal Cleaning Processes regulations detail general and operating requirements as well as equipment specifications.

The following regulations are applicable to the IBM East Fishkill Facility: 6NYCRR Parts 200, 201, 202, 211, 212, 215, 225, 226, 227; 40 CFR 60 Subparts A and Dc; 40 CFR 82 Subpart F. The Potential to Emit of total Hazardous Air Pollutants (HAP) is less than 25 tons per year with no individual HAP greater than 10 tons per year. Therefore the facility is not subject to 40 CFR 63 for Semiconductors.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201.

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application.

The United States Military Academy is an educational institution and an active Army installation. Emissions from the facility of sulfur dioxide, oxides of nitrogen (NOx), carbon monoxide and volatile organic compounds are above major source thresholds, as defined by the Federal Clean Air Act, and therefore, the facility is required to obtain a Title V permit.

As identified in the Title V permit, the United States Military Academy is comprised of 12 emission units. These units are identified and described as follows:

U-604GN: A peak shaving generator, installed in 1999 and located at the Central Power Plant. The generator is rated at 1230 kilowatts and burns diesel fuel. NOx emissions from the generator are limited to 24.0 tons in any consecutive 12 month period, in order to remain below the applicable requirements of 6NYCRR Part 231 New Source Review.

U-604BL: Three boilers located at the Central Power Plant. Boilers #1 and #2 are rated at 150 million BTU per hour and burn number five fuel oil. Boiler #3 is rated at 97 million BTU per hour when burning number five fuel oil and 92 million BTU per hour when burning natural gas. There are limits on NOx emissions (169.6 tons in any consecutive 12 month period), established when Boiler #3 was constructed in 1992, in order to remain below the applicable requirements of Part 231 and 40 CFR 52.21 Prevention of Significant Deterioration (PSD).

Within the next two years, the facility plans to replace Boilers #1 and #2 and add the capability of burning number two fuel oil. The Title V permit includes regulatory requirements due to these proposed changes. These requirements include 40 CFR 60 Subpart Db and limits on NOx and sulfur dioxide emissions, in order to remain below the applicable requirements of PSD. NOx emissions will be limited to 77.1 tons (a zero ton increase from past actuals) in any consecutive 12 month period, and sulfur dioxide emissions will be limited to 91.9 tons (a 7 ton increase from past actuals) in any consecutive 12 month period.

U-845BL: Two boilers located at the Laundry Plant. Both are rated at 55.85 million BTU per hour when burning residual oil and at 58.1 million BTU per hour when burning natural gas.

U-714BL: Two boilers located at the Holleder Center. Both are rated at 14.645 million BTU per hour and burn number two fuel oil.

U-793PT: A spray booth located at the Motor Pool. The booth is used to paint motor vehicles and coat wood furniture.

U-630IN: A veterninary clinic incinerator.

U-845P3: Four fourth generation dry cleaning machines located at the Laundry Plant, which use perchloroethylene.

U-685SV: Two halogenated solvent cleaning tanks. One is a batch, cold solvent, methylene chloride immersion tank. The other is a batch, vapor-top perchloroethylene degreasing tank. Both are used to clean band instrument parts.

U-1202G: A gasoline dispensing unit with three storage tanks located at the Army Air Force Exchange Service Station.

U-719GS: A gasoline dispensing unit with two storage tanks located at the Motor Pool.

U-1720G: A gasoline dispensing unit with one storage tank located at the Camp Natural Bridge Maintenance Facility.

U-1227G: A gasoline dispensing unit with one storage tank located at the golf course.

The following regulations are applicable to the United States Military Academy: 6NYCRR Parts 200, 201, 202, 211, 215, 219, 225, 227, 228, 230 and 232 and 40 CFR 60 Subparts Db and Dc, 40 CFR 63 Subparts M and T, and 40 CFR 82F.

The applicant requests a permit renewal, modification and variance relating to a sand and gravel mine bordered on the west and north by Turtle Bay Road and located approximately 2000 feet east of Lower Road (CR12). The proposal includes the expansion of the mine from 13.5 acres to approximately 15.6 acres. A variance from the minimum setback requirement from property boundaries is requested to mine up to the edge of Turtle Bay Road on the west side of the mine and to excavate through Turtle Bay Road on the north side. At the latter location, Turtle Bay Road will be reconstructed at a lower elevation. All costs for the reconstruction of Turtle Bay Road will be borne by the applicant. With the exception of the reconstructed roadway, all disturbed areas will be graded and vegetated with perennial grasses following completion of mining.

The applicant requests a modification to its existing State Pollutant Discharge Elimination System (SPDES) permit to discharge excess wastewater resulting from the periodic removal of sediment and debris from the intake structure and forebay.
