SEQR Lead Agency: Chester Town Planning Board (Orange Co)
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and made a tentative determination to approve this application to modify the applicant's Air State Facility permit to allow the construction and operation of four new boilers and three new emergency generators at the U.S. Military Academy at West Point. The new emission sources are being constructed in conjunction with various rehabilitation projects to upgrade athletic facilities and to bring the facilities into compliance with current building code, Americans with Disabilities Act (ADA), seismic, fire protection, and gender equity requirements. The (seven) new sources included in this permit are as follows: two boilers (each rated at 6.695 MBTU/hour) and one emergency generator (rated at 469 HP) at the Mitchie Stadium Athletic Center; one boiler (1.63 MBTU/hour) and one emergency generator (536 HP) at the Press Box; one boiler (1.232 MBTU/hour) at the Cadet Crew & Sailing Center; and one emergency generator (804 HP) at the Arvin Cadet Physical Development Center. All generators will burn diesel fuel. The boilers will burn No.2 fuel oil, except for the Press Box boiler which will be fueled by propane. All sources included in the draft permit are grouped under one emission unit (U-700SC).

These sources are subject to the requirements of 6 NYCRR Part 231 New Source Review. The U.S. Military Academy has purchased and shall use 8.26 tons per year of NOx (oxides of nitrogen) Emission Reduction Credits (ERCs). A Lowest Achievable Emission Rate (LAER) must be achieved for NOx emissions; therefore, fuel restrictions to reduce potential NOx emissions from the boilers by 80% are incorporated in the permit, and the hours of operation of the emergency generators is limited to 150 hours per year. To meet the LAER and a NOx emission offset ratio of 1.3 to 1, total NOx emissions from this emission unit is limited to 6.35 tons per year (tpy). Other requirements of the draft permit include: visible emissions are limited to 20 percent opacity (6 NYCRR Part 227-1); and sulfur in the fuel is limited to 1.5 percent by weight (6 NYCRR Part 225-1). The U.S. Military Academy is located in the Town of Highlands, Orange County. A draft permit is available for inspection and comment at the regional office.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and the Federal Clean Air Act Amendments and made a tentative determination to approve this application for Sprague Energy Corporation's facility located in the city of Mount Vernon, Westchester County, New York.

Sprague Energy Corporation is applying for a State Facility Permit for an existing Gasoline Bulk Terminal formerly owned and operated by Amoco Corporation. The facility consists of 17 above ground storage tanks storing gasoline and/or distillate oil and one truck loading rack for gasoline. To control volatile organic compound (VOC) emissions, the gasoline storage tanks are equipped with internal floating roofs and the gasoline truck loading rack is equipped with a vapor recovery unit.

The facility is proposing to accept federally enforceable permit conditions to limit gasoline throughput to 118,000,000 gallons per any consecutive twelve month period and to limit distillate fuel oil throughput to 100,000,000 gallons per any consecutive twelve month period to remain below the applicability requirements of Title V and the National Emission Standards for Gasoline Distribution Facilities, 40 CFR 63, Subpart R. The facility will maintain daily records to ensure compliance with the throughput limits.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

The Application and Draft Permit are available for review at the Region 3 Office of the New York State Department of Environmental Conservation.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
