Project Description: REVISED PROJECT APPLICATION - The permit holder, NYCO Minerals, Inc., has revised a proposed amendment to APA Permit 96-76 (designated as Project 2000-58) to authorize relocation of a mine road approximately 7,000 feet in length after the fact. The mine road is intended to provide access for ore trucks and machinery directly from NYS Route 9 to the approved Oak Hill mine site in the Town of Lewis. A previous project notice described the permit amendment as the relocation of 4,181 feet of the mine road. Revised plans received on June 8, 2001, depict almost the entire road as having been relocated. The easterly portion (approximately 3,000 feet) of the road has been constructed approximately 400 feet to the west of the location approved in Permit 96-76, closer to Pulsifer Road.

Project Description: The action involves the replacement of two stream crossings over Bishop Brook involving wetlands on a 30 ± acre property in Rural Use. The project consists of construction of a single span bridge on one crossing with concrete abutments and stone rip rap to be placed on stream banks and the installation of a culvert on the second crossing.

Negative Declaration

Saratoga County - The Town of Ballston, as lead agency, has determined that the proposed Burnt Hills Ballston Lake Water district No. 2 Extension 12 will not have a significant adverse environmental impact. The action proposes to install approximately 15,100 linear feet of water main to extend Burnt Hills-Ballston Lake Water District No. 2 to serve Brookline Road and NYS Route 67 in the Town of Ballston. The project is located on Route 67 and Brookline Road, Town of Ballston.

Washington County - The New York State Department of Environmental Conservation, as lead agency, has determined that the proposed William Boyce, B.J. Farms, Battenville Pit will not have a significant adverse environmental impact. The B.J. Farms is proposing to continue surface mining of Sand and Gravel from 13.95 acres of a 144.6 acre property. This activity has taken place at this location for many years with a total area affected of 2.0 acres to date. The mining will be conducted at a level of intensity that will exceed the specific threshold (more than 1000 tons per year) requiring a permit. Mining would be conducted in 2 phases; the duration phase one will be approximately 5 years and Phase 2 will be approximately 2 years. Unconsolidated materials would be excavated from the existing mining face working away from the existing excavation face and moving west toward the life of mine boundary. The proposed mining operation will utilize a front end loader to excavate sand and gravel. No processing of the excavated material is proposed for the site. A 1400 foot haul road would provide direct access to NYS Route 29 (NYS Department of Transportation). The excavated material will be drawn from the mine face to the specific job sites by tandem axle dump trucks. At maximum capacity the facility will have ten loaded trucks per hour leaving the mine site. The reclamation objective is to create land suitable for agriculture. Following DEC staff’s inspections of the proposed mine site on 2/13/2001 and its review of the mining permit application, the mined land use plan, the mined land reclamation plan and the full environmental assessment form the relevant areas of environmental concern have been identified. These areas of concern are the normally associated impacts of an unconsolidated material mining operation specifically ground water contamination, impact on the unconsolidated Aquifer, surface water contamination, dust, erosion, traffic, noise and visual. All other impacts were judged to be either non-significant or improbable and therefore, not relevant to the lead agency’s determination of environmental significance. Based on the information provided and analysis conducted by DEC staff, it is determined that the proposed action will not result in any significant adverse environmental impacts. Notice of Completion of Final Supplemental EIS

Warren County - The Lake George Park Commission, as lead agency, has accepted a Final Supplemental EIS on the proposed Lake George Sonar® Demonstration Project. The action involves the treatment of four locations comprising approximately 36 acres of Lake George (total lake surface approximately 28,000 acres) with Sonar® (fluridone), an aquatic herbicide, for Eurasian Watermilfoil control. The project will encompass an evaluation of Sonar® efficacy and impacts for incorporation into a comprehensive program of Eurasian Watermilfoil management. The project is located on Sawmill Bay, Paradise Bay, West Tongue Mountain\Northwest Bay and Moonlight Bay\Harbor Islands, Town of Bolton.
