|Notice of Lodging of Stipulation and Order of Settlement|
Notice is hereby given that on June 13, 2001, a proposed Stipulation and Order of Settlement in The State of New York v. the United States Department of Agriculture, Civil Action No. 98-3768 (TCP/ETB), was lodged with the United States District Court for the Eastern District of New York.
The complaint in this action alleges that the United States Department of Agriculture ("USDA") has been violating the Water Pollution Control Act, Article 17 Title 8 of the State Environmental Conservation Law ("ECL"), by discharging wastewater from the Plum Island Animal Disease Center Water Treatment Plant, located in Orient Point, New York, in excess of three effluent limitations in its State Pollutant Discharge Elimination System ("SPDES") permit.
The Stipulation and Order of Settlement requires the USDA to implement a schedule that sets forth specific dates by which it must implement plant modifications, capital improvements and operational changes to bring the water treatment plant into compliance with the Water Pollution Control Act. The Office of the New York State Attorney General will receive comments relating to the proposed Stipulation and Order of Settlement for a period of thirty (30) days from the date of this publication. The proposed Stipulation and Order of Settlement may be examined at the Office of the New York State Attorney General, 120 Broadway at Rm. 26-124, New York, New York, and at the Region I Office of the New York State Department of Environmental Conservation, State University of New York Campus, Loop Road Building 40, Stony Brook, New York 11790.
