NOTICE OF PUBLIC HEARING
NEW YORK STATE
DEPARTMENT OF ENVIRONMENTAL CONSERVATION (Department)

Pursuant to Sections 1-0101; 3-0301; 19-0103; 19-0105; 19-0301; 19-0303; and 19-0305, the Department gives notice of public hearings:

DATE: MONDAY, JULY 30, 2001
TIME: 1:00 P.M.
PLACE: Clean Communities of Central New York
Applied Technology Center, Suite W206
Onondaga Community College
4915 Onondaga Road
Syracuse, NY 13215
(phone 315 498-2548)

DATE: TUESDAY, JULY 31, 2001
TIME: 1:00 P.M.
PLACE: USEPA, 290 Broadway, 27th floor, Conference Room D
New York, NY 10007
(phone 212 637-3333)
USE ENTRANCE AT CORNER OF DUANE AND BROADWAY

Purpose: The U.S. Environmental Protection Agency (EPA) has promulgated rulemakings removing the requirement that oxygenated gasoline be used in both the New York City Consolidated Metropolitan Statistical Area (CMSA) and the Syracuse Metropolitan Statistical Area (MSA) during winter months. Being revised is 6 NYCRR, Subpart 225-3, Fuel Composition and Use - Gasoline. Part 200, General Provisions, will also be revised to reflect the changes to Subpart 225-3.

The amendments to Subpart 225-3 remove the requirement that oxygenated gasoline be used in the New York City and Syracuse Metropolitan areas during winter months. The use of oxygenated gasoline is currently required in the State Implementation Plan for carbon monoxide for Onondaga County (CO SIP) as a contingency measure. The CO SIP will be revised to substitute the automobile inspection and maintenance program for the oxygenated fuel requirement.

In addition, the ozone SIP is being revised to include a document entitled, "RACM Analysis for the New York Portion of the New York Metropolitan Area Severe Ozone Nonattainment Area." The results of this analysis show that there are no reasonably available control measures (RACM) to advance the ozone attainment date from 2007 to 2006.

The Department invites all persons, organizations, corporations, and government agencies that may be affected by the proposed actions to attend the hearings and / or submit oral or written statements for the record. At the hearing, each person who wishes to make a statement will be allowed to speak. The Department will give equal weight to written and oral statements and recommends that all statements be submitted in writing. A cumulative record will be compiled; therefore, it is not necessary for interested parties to attend both hearings.

For further information, contact Steven Botsford, P. E., at the address below. Written statements may be submitted to the Department until close of business, 5 p.m., August 6, 2001, and should be submitted to:

This notice announces the availability of the New York State Department of Environmental Conservation’s DRAFT Consolidated Assessment and Listing Methodology for public comment. Public comment on this document will be accepted for 45 days, through August 17, 2001.

BACKGROUND: The Clean Water Act requires states to assess and periodically (every two years) report on the quality of their waters. The NYSDEC Division of Water is developing a Consolidated Assessment and Listing Methodology to outline in considerable detail the process the Department follows in monitoring and assessing the quality of New York State waters. Section 303(d) of the Clean Water Act also requires states to identify a list of Impaired Waters, where specific designated uses are not fully supported. For these Section 303(d) Listed Waters, states must consider development of a Total Maximum Daily Load (TMDL) or other strategy to reduce the input of the specific pollutants that restrict waterbody uses, in order to restore such use. Additional objectives of the Methodology are to clarify the water quality assessment and Section 303(d) listing process and improve the consistency of assessment and listing decisions.

The Methodology consists of three (3) separate parts. The Monitoring Strategy provides an overview of the NYSDEC water quality monitoring program. The Assessment Methodology details the evaluation of monitoring data and information to determine levels of water quality and use support. And, lastly, the Listing Methodology outlines the identification and prioritization of waters that do not meet water quality standards or support designated uses.

INFORMATION: Copies of the entire DRAFT Consolidated Assessment and Listing Methodology can be obtained by contacting the NYSDEC Bureau of Watershed Assessment and Research by mail at 625 Broadway, 4th Floor, Albany, NY 12233-3502, or by phone at 518-402-8179. Public comments regarding the methodology should be mailed to the Bureau of Watershed Assessment and Research at the above address.

Pursuant to Section 3-0301(2)(m)of the Environmental Conservation Law, the New York State Department of Environmental Conservation hereby gives notice of the following: Final agency action to adopt amendments to multiple parts of 6 NYCRR to change the address of the Central Office of the Department from 50 Wolf Road, to 625 Broadway, Albany NY 12233.
