Allegany County Department of Public Works proposes the periodic removal of gravel bars in Canaseraga Creek within 500 feet upstream to 500 feet downstream of the County Road 15B bridge at Garwoods. Gravel excavation will be above the "ordinary low-water elevation". Some of the gravel will be used to fill and shape about 150 lineal feet of eroding south stream bank, immediately east of the bridge abutment.

The Department has prepared a draft permit and made a tentative determination to approve this application for new SPDES Permit No. NY-0258962 for a proposed discharge of 1,300 gallon per day (GPD) from a Tavern/Restaurant and 750 GPD from a House/General Store of sanitary wastewater into an unnamed Class C tributary of the Allegany River Reservoir, after treatment by septic tank, sand filter and chlorination. The facility is located at the applicant's address on the north side of West Perimeter Road, 1,000 feet East of Sawmill Run Road. The application and draft permit is available for review and comment at the NYSDEC Region 9 Office.

The applicant proposes to install concrete riprap along two 75 lineal foot sections and one 150 lineal foot section of Mud Creek to prevent further erosion. The site is located along the applicant's property at 297 Mud Creek Road.

The Department has drafted modified permit pages for SPDES Permit No. NY-0001368 and made a tentative determination to approve this application for the additional discharge of treated rain water and snow melt that accumulates on SWMUs (solid waste management units) S-1 and S-5 into Smoke Creek. Operating facilities which are collectively called the Lackawanna facilities are the coke ovens (Lackawanna Coke Division) and the pickler, cold mills, and galvanizing mill (Lackawanna Galvanized Products Division). These facilities are located just south of the City of Buffalo and stretch along a three mile section of the eastern shore of Lake Erie on both sides of NYS Route 5.

The applicant proposes the expansion of the wehrle Drive Quarry, an existing limestone mine, to include an additional 19.0 acres. The total approved acreage would be 596 acres out of a total of 879 acres owned by the applicant at this location. The reclamation objective is a lake. The mine expansion area is located approximately 1000 feet southwest of the intersection of Wehrle Drive and Barton Road.

The applicant proposes construction of two retention ponds and a grass swale in the 100 foot adjacent area of New York State Freshwater Wetland WO-41 as part of the erosion and sedimentation control plan for the construction of Forest View Estates Subdivision on Keller Road.

The Department has prepared a draft permit and made a tentative determination to approve this application for new SPDES Permit No. NY-025 8156 for an existing discharge of varying amounts of stormwater from 8 outfalls to Cayuga Creek (Class C) via various unnamed tributaries and storm drains. The facility, which produces ready- mixed concrete and concrete products, is located southwest of the intersection of Cory and Walmore Roads. The Draft Permit and application is available for review and comment at the NYSDEC Region 9 Office.

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and the Federal Clean Air Act Amendments and made a tentative determination to approve this application for the Attica and Wyoming Correctional Facilities. The two prisons at Attica and Wyoming will be covered by one State Air Facility permit because they are contiguously located on the same property. The Attica facility fabricates and paints Corcraft metal cabinets and lockers. Its batch burn-off oven designed to remove dried paint off conveyor hooks is the only process emission source that requires permitting. This process source's emission limits are referenced under 6NYCRR Part 212 in the permit. The permit contains federally enforceable annual emission caps which limit the facility use of both distillate oil and natural gas in stationary combustion sources, and restricts #2 distillate oil to an upper sulfur content limit of 0.5% by weight. Such caps limit the facility's potential to emit (PTE) for CO, NOX and SO2 below Title V thresholds thereby eliminating the need for Title V permitting. Heating needs for both facilities are met by the operation of six dual fuel (natural gas and No. 2 fuel oil) boilers. The facility's three newest boilers require the 0.5% percent by weight sulfur limitation found in 40CFR 6.42c(d) NSPS Subpart Dc and this limit is included in this permit. The same sulfur limit also covers the limit found in 6NYCRR Part 277-1.2(a) that is a requirement for all the remaining older boilers. A permit condition will restrict the operating time of the turbine and diesel generators to under 500 hours each and they will be used for emergencies only. As long as the turbine generator is used for emergency use only it will be exempt from the requirements of CFR 60.332 Standard for Nitrogen Oxides found in Subpart GG - the Standards of Performance for Stationary Gas Turbines. In addition the diesel generators and the turbine generator will be exempt from permitting as per Part 201-3.2c(6). The application and Draft Permit are available for review at the Region 9 office of the New York State Department of Environmental Conservation.

The applicant proposes to realign approximately 350 feet of stream channel on Wiscoy Creek. The purpose of the project is for flood control and to prevent continuing erosion of a steep bank. The site is located south of Route 39, one half mile east of Hardy Road
