Project Description:

The applicant proposes to excavate a recreational pond approximately 200' long x 75' wide x 5'-6' deep at the family camp off Mill Stream Road, east of the Salmon River Road on Tug Hill, 10 miles north of the hamlet of Osceola. The pond would be excavated in the flood plain of Mill Stream, a minimum of 10' from the normal stream channel.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

Applicant is proposing to construct and operate a facility that will manufacture oriented stand board, a composite wood panel utilized in the building industry. The facility will operate 24 hours/day, 7 days/week and have a production capacity of 480 million square feel per year of 4' x 8' x 3/8" oriented strand board. The facility will be located on a 70.85 acre parcel of land, in the Town of Lisbon, owned by the Ogdensburg Bridge and Port Authority. The Department previously issued a Synthetic Minor Air State Facility Permit for this project on June 29, 2000. A "synthetic minor permit" requires the proposed facility to cap and limit its emissions below the thresholds for a Title V permit under the Federal Clean Air Act. In requesting such a synthetic minor permit, the applicant has agreed to keep its emissions below such federal thresholds.

As the result of a New York State Supreme Court ruling, the applicant was required to provide supplemental information that was not included in its original or revised applications, dated December 22, 1999 and April 14, 2000, respectively. In response to this supplemental information, the Department is reissuing the Synthetic Minor Air State Facility Permit with only minimal changes from the June 29, 2000 permit. The changes were made at the request of the Environmental Protection Agency in order to increase the amount of monitoring and recordkeeping the facility must perform. Upon issuance the revised Synthetic Minor Air State Facility Permit for Chatham Forest Products will allow construction and operation of an oriented strand board plant to be located on Wagner Road in the Town of Lisbon.

The applicant has accepted permit conditions that make the facility a synthetic minor for emissions of Volatile Organic Compounds (VOC), Oxides of Nitrogen (NOx), Particulate Matter (PM & PM-10), Carbon Monoxide (CO), and Hazardous Air Pollutants (HAP). These permit conditions limit emissions of the above pollutants to less than the major source applicability thresholds for Title V (6 NYCRR Part 201-6), New Source Review in Non-attainment Areas and Ozone Transport Regions (6 NYCRR Part 231-2), and Prevention of Significant Deterioration (40 CFR Part 52.21). The Department has reviewed this project to determine if it is subject to New York State New Source Review in Non-attainment Areas and Ozone Transport Regions codified at 6 NYCRR Part 231-2. NYS DEC has determined the project is not subject to this regulation. The Department has reviewed this project to determine if it is subject to Federal Prevention of Significant Deterioration regulations codified at 40 CFR Part 52.21. NYS DEC has determined the project is not subject to this regulation. The permit conditions will reduce emissions to a level below the significant source project thresholds of the above regulations. The Department has also reviewed this project to determine if it is subject to the Title V Facility Permit regulations codified at 6 NYCRR part 201-6. NYS DEC has determined the project is not subject to this regulation. The permit conditions will reduce emissions to a level below the major stationary source threshold of the above regulation. By accepting these, state and federally enforceable, permit conditions the applicant will not be required to comply with these regulations. The applicant will be required to comply with all other applicable regulations and such limitations are contained in the draft permit.

The draft permit for this project is available for inspection at the DEC Region 6 office located at 317 Washington Street, Watertown, New York 13601, the Town of Lisbon Town Hall, Lisbon, New York 13658, City of Ogdensburg public library, 312 Washington Street, Ogdensburg, New York 13669 and the Ogdensburg Bridge and Port Authority office, One Bridge Plaza, Ogdensburg, New York 13669.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NONE DESIGNATED
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
