Project Description:

The State of New York Department of Transportation (DOT) has applied for a Freshwater Wetlands Article 24 permit to disturb 2.196 acres of state regulated wetland UW-8. This disturbance is in conjunction with the Judd Road Connector project which will link Judd Road in the Town of Whitestown to the Route 5 & 12 intersection and Route 8 in the Town of New Hartford. DOT has prepared a Final Wetland Mitigation Report that is availible for review at the New York State Department of Environmental Conservation office at 207 Genesse Street, Utica, New York.. DOT proposes a combination of mitigation including wetland creation, buffer area acquisition, and wetland/public benefit projects.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

This permit is for a modification to process CL1 through CL5. Five Natural Gas fired burners were replaced with 16mmBtu burners for the didion drums, 6 new non-contact cooling towers will be installed, and the L61 sand coolers will be replaced by a more efficient 2-state design. The effected emission points are: 97, 98, 116, 117, 118, 125, 126, 127, 133, 134. This permit includes federally enforceable conditions to limit considered to "cap" emissions below the applicable threshold level as set forth in 40 CFR 51.21 Prevention of Significant Deterioration (PSD) and 6 NYCRR part 231 New Source Review (NSR). The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.
