Project Description:

The Applicant proposes to construct and operate a power generating facility capable of producing 79.9 megawatts of electricity. The plant will be located on a floating barge (220 feet by 90 feet) anchored on the west side of the Wallabout Channel at the Brooklyn Navy Yard, near the intersections of Kent Avenue and Clymer Street and between the Williamsburg and Manhattan Bridges in Brooklyn Community District No. 2. The barge will be brought to the site where the Applicant will perform additional work including the driving of four piles for mooring and installation and connection to existing underground utility lines. The facility would include two combustion gas turbine generators with dry low oxides of nitrogen combustors. Primary fuel will be natural gas with low sulfur distillate as a back-up fuel. The project is also to include a heat recovery steam generator with a selective catalytic reduction system and a catalytic oxidation system for carbon monixide emission control. The project's location may require the boring of a conduit underneath the Wallabout Channel from the south side of the Channel to the north side for the purposes of interconnecting the generating facility to gas, electric, water and sewer systems. The project would encompass 18,000 square feet of water surface and 8,000 square feet of roads,buildings and driveways.

PERMITS AND AUTHORITY

This application is for a federal Title IV (Acid Rain) permit only, required pursuant to Title IV of the Clean Air Act Amendments of 1990 and 40 CFR Part 72. The Department has determined that the proposed facility meets applicable requirements and has prepared a draft permit.

This air permit application is being reviewed pursuant to 6NYCRR Part 617 (SEQR); Part 621 (Uniform Procedures); and Part 624 (Permit Hearing Procedures). The Applicant applied for a State air pollution control permit (pursuant to Article 19 of the Environmental Conservation Law, and Part 201 of Title 6 of the New York Code of Rules and Regulations). That application was the subject of a a public hearing on January 10, 2001; the Department issued that permit on January 18, 2001.

DOCUMENT AVAILABILITY

The Department has reviewed the application materials and concluded that they are complete, and made a tentative determination to approve the application. The Department has found that all statutory and regulatory criteria can be met through the permit and its special conditions. Accordingly, a draft permit has been prepared. The application materials and the draft air permit are available for review during normal business hours, Monday through Friday, at the following locations:

WRITTEN COMMENTS

Parties may file written comments with the Department's project contact, John J. Ferguson, Project Manager, at the above address. Pursuant to 6NYCRR Parts 621, Department staff will review all public comments, including requests for a public hearing, and shall determine whether further proceedings are required. Written comments must be postmarked no later than July 13, 2001.

NEGATIVE DECLARATION

The New York City Environmental Quality Review, on January 10, 2000, the New York City Department of Environmental Protection, as lead agency, determined that the proposed project would have no significant effect on the environment upon meeting the conditions of the Conditional Negative Declaration (CND).

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: NYC DEP
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than Jul 13 2001.
