The New York State Department of Environmental Conservation (NYSDEC) has received requests to modify permits to operate air contamination sources for the following facility:

These modifications are being proposed by the permittee for the purpose of restricting the potential to emit sulfur dioxide (SO2) from these emission sources, through (state and federally) enforceable permit conditions and limits which will "cap" emissions at levels which are below the applicability threshold(s) as specified in the following regulations: Title V (40 CFR 70) of the Clean Air Act Amendments of 1990. Any facility meeting the requirements to "cap-out" of 40 CFR 70, will be subject to all other applicable requirements of 6 NYCRR.

The applicant(s) have agreed to permit conditions which will limit emissions of sulfur dioxide through restrictions on one or more of the following: production throughput (quantity), quantity of fuel burned, sulfur content in fuel, and hours of operation (daily, weekly, monthly or annually). The permittees will be required to maintain records, and report this data to verify compliance with permit conditions and limits. The permits, with conditions are available at Region 7 Headquarters. State Historic Preservation Act (SHPA) Determination: A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has made a tentative decision to issue a permit for a project to construct an angled "L" shaped wave break constructed of rip rap. The project purpose is to improve fisheries habitat in Onondaga lake. The portion extending off shore will start 30 feet from shore and run for 150 feet then another 150 feet portion will run parallel to the shore. The dimensions of the structure will be 5 feet wide on the top surface 15 feet wide at the base; with a maximum vertical height of about 5 feet high. Under normal lake elevations, the top of the wave break will be one foot above the water along its entire length. Four 10 meter X 10 meter areas of 1-2 inch diameter stone will be placed within the protected area and will provide improved spawning habitat. Stone will be placed from a barge and navigation buoys will be installed. The project will be built in the northwest corner of Onondaga Lake in the Town of Geddes County of Onondaga.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

These modifications are being proposed by the permittee for the purpose of restricting the potential to emit volatile organic compounds (VOC's) and hazardous air pollutants (HAP's) from these emission sources, through state and federally enforceable permit conditions and limits which will "cap" emissions at levels which are below the applicability thresholds as specified in the following regulations: Title V (40 CFR 70) of the Clean Air Act Amendments of 1990. Any facility meeting the requirements to "cap-out" of 40 CFR 70, will be subject to all other applicable requirements of 6 NYCRR. The applicant has agreed to permit conditions which will limit emissions of VOC's and HAP's, through the employment and operation of control equipment and restrictions on one or more of the following: quantity of VOC containing compounds utilized, production throughput (quantity), and hours of operation (daily, weekly, monthly or annually).
