Notice of Intent to Issue a Certificate Pursuant to Section 401 of the Federal Clean Water Act

Project Title: Case 00-T-1831 B Cross Sound DC Cable

Project Location: The waters of Long Island Sound and the grounds of the former Shoreham Nuclear power plant.

Brief Project Description: The Public Service Commission (PSC) proposed to issue a Section 401 Certification pursuant to the Federal Clean Water Act and Article VII of the New York State Public Service Law, to the Cross Sound Cable Company (New York). This action is in connection with construction of a 24-mile underground/underwater HVDC electric transmission line underwater from New Haven CT, to the Shoreham Nuclear Power Plant site in the Town of Brookhaven, Suffolk County.

This electric line project is before the Public Service Commission in Case 00-T-1831.

The proposed project will cross Long Island Sound. No other protected waters will be crossed.

The PSC is reviewing this case prior to issuance of an Article VII Certificate of Environmental Compatibility and Public Need. The company will eventually file an Environmental Management and Construction Plan for this project, which will provide details of construction and mitigation methods to reduce impacts on Long Island Sound.

A draft Water Quality Certification, including conditions, is available from the contact person listed below. Written comments on the proposed Water Quality Certification will be accepted if filed within 15 days of publication of this notice. Address written comments to Secretary Janet H. Project Description: The applicant holds waste transporter permit 1A-483 authorizing the transport of regulated waste. The Department has determined that the applicant’s record of noncompliance with the Environmental Conservation Law ("ECL") and the rules and regulations promulgated thereunder at 6 NYCRR, as enforced by the Department constitute grounds for revocation of the DEC Part 364 Waste Transporter Permit issued to the applicant. Accordingly, the Department has prepared a "Notice of Intent to Revoke Permit" and intends to revoke this permit effective May 1, 2001. The permittee is no longer licensed or permitted to handle such waste.

SERP Action - Negative Declaration

Nassu County - Pursuant to the NYS Clean Water/Drinking Water State Revolving Fund and the State Environmental Quality Review Act, DWSRF Project #16742, the Port Washington Water District, as lead agency, has determined that the proposed Construction of Water Treatment Facilities will not have a significant adverse environmental impact. This action involved the construction of a water treatment facilities to remove organic chemical constituents by means of air stripping from the discharge of wells N7551 and N7552 (Morley Park Wells 8 and 9) serving communities within the Port Washington Water District. The project is located on the east side of Searingtown Road, approximately 1,000 feet north of the Long Island Expressway, North Hills, NY.

Negative Declaration

Suffolk County - The New York State Department of Transportation, as lead agency, has determined that the proposed Long Island Expressway Service Roads, Exits 63-67 will not have a significant adverse environmental impact. The action involves the completion of the Long Island Expressway Service Roads system between Exits 63 (North Ocean Avenue/CR 83) and Exit 66 (Sills Road/CR 101) as well as completing/upgrading the existing interchanges between Exits 63 and Exits 67 (Yaphank Avenue/CR 21). The total length of the project is approximately 6.5 miles, all in the Town of Brookhaven, Suffolk County.

Notice of Acceptance of Draft EIS and Public Hearing

Nassau County - The Nassau County Planning Commission, as lead agency, has accepted a draft EIS on the proposed Waterview Estates at Merrick. A public hearing on the draft EIS will be held on Thursday, June 7, 2001 at 9:45 a.m. at the office of the Nassau County Planning Commission, Administration Building, 400 County Seat Drive, Mineola, NY. Written comments should be addressed to Howard Blankman, Chairman, Nassau County Planning Commission and will be received until 4:45 p.m. on June 18, 2001 and in the event that the hearing is adjourned to a later date, for a period of 10 days following the close of the Public Hearing. The action involves the construction of 6 single family homes on a 2.78 acre parcel. The project is located at the south end of Wynsum Avenue near the intersection of Ilona Lane, Merrick, Town of Hempstead.
