Project Description: The department proposes to modify the State Pollutant Discharge Elimination System (SPDES) as follows: The reporting of theraputic chemicals is modified so that all instances of treatment will be on a new table appended to the Discharge Monitoring Report (DMR). This will permit the reporting of actual concentrations, dates, and duration of treatment and the resulting concentration of the treatment chemical in the receiving waters based on actual flow. Monitoring information has been updated to include the location of flow monitoring for hatchery flow, stream flow, and treated hatchery flow. These flows are used in the calculation of in-stream concentration of theraputic chemical. The reporting periods have been extended from 28 days to 60 days. |

Project Description: The Department has prepared a draft permit and made a tentative determination to issue a modified permit, # NY-0167169, at the applicant's request for removal of nitrate effluent limits and reduced testing frequency at the Clarence Research Park WWTP, located at 10000 Wehrle Dr., in the Town of Clarence. The existing WWTP with a permitted flow of 20,000 gpd discharges to groundwaters. The proposed permit deletes nitrate limits based on Departmental regulation, 6NYCRR 702.21, "Exceptions to Groundwater Effluent Limitations". Also, secondary treatment limits have been incorporated into the permit, consistent with regulatory guidance, which should prevent nuisance conditions. A request to reduce monitoring from every day to five days per week has been denied per the "Technical and Operational Guidance Series No. 5.1.6" The draft permit and applicable regulations are available for inspection at the Department's Region 9 Office during normal business hours. |
