Notice of Public Scoping Information Meeting and Closing of Public Scoping Comment Period

Public Scoping Meeting and Closing of Comment Period - The New York State Department of Public Service (NYS DPS) and the New York State Department of Environmental Conservation (NYS DEC) will be conducting a public information scoping meeting to discuss draft stipulations which have been developed for the project proposed by Besicorp-Empire Development Company, LLC, to construct and operate the Empire State Newsprint Project (ESNP), a proposed integrated facility consisting of a 510 Megawatt combined cycle electric generation facility and a recycled newsprint manufacturing facility. The stipulations which have been developed will become written agreements among the applicant, various state agencies, and other stakeholders which establish the scope of environmental impact studies and other information needed to meet the requirements for application under Article X of the Public Service Law and its implementing regulations. These stipulations, covering all aspects of the electric generation proposal including environmental impacts on air, water, visual resources, land use, noise levels, health and other studies, will also serve as the issues to be addressed in the State Environmental Quality Review Act (SEQRA) review of the Empire State Newsprint Project by the NYS DEC in itís role as Lead Agency under SEQR.

This Public Scoping Meeting to receive final public comment on the proposed stipulations which will guide issues and studies appropriate for the environmental impact assessment of the integrated ESNP facilities will be held on Thursday, May 24, 2001 from 7:00 PM to 9:00 PM at the City of Rensselaer Junior/Senior High School (School Auditorium), 555 Broadway, Rensselaer, New York. Oral or written comments may be presented during this session. It is not necessary to file in advance to speak at the Public Scoping Meeting. Lengthy statements should be in writing and summarized for oral presentation. Written comments regarding the SEQRA review of this project will be accepted until the close of the comment period on May 31, 2001. Project Description and Details - This notice supplements a combined notice for a Public Information Forum and Public Scoping Meeting previously issued by the NYS DPS on January 17, 2001 and a Positive Declaration and Notice of Public Scoping issued by the NYS DEC on January 31, 2001 which included publication in the Environmental Notice Bulletin. Details regarding the ESNP project description, location and general review process can be found in these announcements.

Negative Declaration

Otsego County - The Town of Otsego, as lead agency, has determined that the proposed Local Ordinance - Otsego Lake 200 ft. no-wake zone will not have a significant adverse environmental impact. The action involves the enacting of a local ordinance to establish a 200 ft. no-wake zone along its boundary on Otsego Lake. Regulatory-type buoys will be used to mark the zone, and will be labelled "SLOW 5 MPH". The project is located on Otsego Lake.

Positive Declaration

Albany County - The City of Albany Planning Board, as lead agency, has determined that the proposed Site Plan Review may have a significant adverse environmental impact and a draft EIS must be prepared. The action involves a 5.9 acre for the construction of a five story residential apartment building and related garage. The project is located at 106-112 Van Rensselaer Blvd., in R-4 Multifamily High Rise Residential Zoning District, City of Albany.

Rensselaer County - The Town of Stephentown Planning Board, as lead agency, has determined that the proposed Stephentown Communications Facility may have a significant adverse environmental impact and a Draft EIS must be prepared. The action involves the construction of an approximately 100 foot lattice communications tower with appurtenances (such as antenna which may extend over the aproximately 100 ft. tower) to be placed on a crushed stone yard with chain link security fencing with a 12 foot wide gravel access drive with all necessary utilities and connecting appurtenances. The project is located on Partridge Lane, Town of Stephentown.

Notice of Acceptance of Draft EIS

Rensselaer County - The NYS DEC as lead agency has accepted a Draft EIS for the proposed Grafton Quarry, a 68-acre Life of Mine, rock mine to be located on a 115-acre site located on NYS Route 2, four miles west of the hamlet of Grafton, and 1 Ĺ miles northeast of the hamlet of Cropseyville in the Town of Grafton, Rensselaer County. The project is proposed by R. J. Valente Gravel, Inc., 8 Jennifer Drive, Wynantskill, NY 12198.

A Legislative Hearing will be held on Tuesday, May 22, 2001 at 7:00 p.m. at the Town of Grafton Town Hall, Route 2, Grafton, NY. Written comments on the project may be submitted to the contact person no later than June 8, 2001.
