Project Description:

The applicant proposes to increase final grade slopes on the east and west sides of the landfill from 1 ft. vertical to 5 ft. horizontal to1 ft. vertical to 3 ft. horizontal. The current design slopes of the north and south landfills sides are 1 ft. vertical to 3 ft. horizontal. The grading of the landfill top would also be reconfigured to slope to the north and south, rather than to the east and west. This modification design of the landfill final grade slopes and landfill top will increase the design waste capacity by approximately 210,000 cubic yards and the landfill life by approximately 6 months. The final elevation of the landfill top remains unchanged.

State Environmental Quality Review (SEQR) Determination: Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination: A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes a 10.6 acre expansion of the "Willing Gravel Pit", presently permitted for 43 acres, and to mine below the ground water table on the existing mine and the expansion area, which will create a 20 acre lake. The anticipated life of the expanded mine is 20 years and the reclamation objective is sloping meadows for the mine areas above the lake water elevation. The mine is located at the northeast corner of the intersection of Hawks Road and Butler Road. The expansion area is immediately north of the current north mine limit.

State Environmental Quality Review (SEQR) Determination: Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

The applicant proposes to mine soil material with no on-site processing, on one (1) acre of land. The haul road is an existing farm lane that provides access to Snow Brook Road. The mine is intended to provide fill material for a New York State Department of Transportation highway project. The extimated life of the mine is less than one year and the reclamation objective is a 0.7 acre excavated pond surrounded by meadow. The site is on land owned by Daniel Brown and is located about 1,000 feet north of Snow Brook Road and 1,300 feet east of Bear Hollow Road .

Project Description:

The Department has drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application for the manufacturing of breakfast cereals at General Mill's Cereal Plant located at 54 South Michigan Avenue in the City of Buffalo. The General Mills facility includes a co-located flour processing mill and a co-generation plant for which separate Title V Permits will be issued. Air contaminants emitted from the Cereal Plant include nitrous oxides (NOx), sulfur dioxide (SO2), volatile organic compounds (VOCs), particulates (PM/PM-10) and hazardous air pollutants (HAPs). This initial Title V Permit will result in no changes in Cereal Plant operations.

General Mill's facility-wide potential to emit SO2 and PM/PM-10 exceeds the major source thresholds of 100 tons each per year listed in 6 NYCRR Subpart 201-6 - Title V Facility Permits and is therefore subject to the provisions of Title V. In addition, General Mills has an annual potential to emit greater than 50 tons of VOCs from emission sources subject to 6 NYCRR Subpart 212.10 - "Reasonably Available Control Technology (RACT) for major facilities". This regulation has an applicability threshold of 50 tons per year (tpy) based on the potential to emit VOCs from all sources at the facility, including the flour mill and the co-generation plant. In 1995 to avoid the control requirements specified for VOC RACT in accordance with 6 NYCRR 212.10(d), General Mills chose to limit the amount of VOCs emitted from the facility to 49 tpy determined by summing the individual monthly VOC emissions during any consecutive 12-month period. All emission points at the General Mills Cereal Plant are also subject to the applicable requirements of 6 NYCRR 212 for particulates. This Title V Permit specifies special operating/monitoring conditions, recordkeeping and reporting required to verify compliance with applicable requirements. The facility is currently in compliance with all requirements.

The application, draft permit, relevant supporting materials, and regulations are available for review during normal business hours at the regional office. Written comments may be made within the 30 day period ending on the last filing date indicated in this notice. The Department may modify the draft permit based on significant or important information raised during the comment period. The Department may also schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. A hearing notice would contain instructions for filing party status and submitting comments. In accordance with 6 NYCRR Part 621.5(d)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency (EPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act or 6 NYCRR Part 201. Following the 30 day comment period, the EPA will have an additional 45 days to review the draft or modified draft permit. If the EPA does not raise any objection in that time, the Department may then issue the final draft permit as the Title V Permit.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
