The Department has drafted a State Facility Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and has made a tentative determination to approve an application for modifications at the Bristol-Myers Squibb facility located in East Syracuse, NY. The proposed permit modification authorizes a 39 ton/year increase in the facility’s annual NOx cap after successful installation and testing of low NOx burners for three mid-size industrial boilers located at the facility. The proposed modifications also include the addition of distillate fuel oil combustion capability for two boilers, triggering NSPS Subpart Dc (40 CFR 60 Subpart Dc). A separate permit limitation restricts annual NOx and SO2 emissions from these boilers below the Federal Prevention of Significant Deterioration (PSD) applicability levels codified in 40 CFR 52.21. The Department has made a tentative determination to approve this application for a new permit for the Candor Elementary, Middle, and High Schools for both existing discharges of sanitary wastewater totaling 7,120 gallons per day and for proposed discharges of sanitary wastewater totaling 7, 050 gallons per day. All discharges will be to groundwater.
