Project Description: This is a renotice of the December 11, 2000 permit notification incorporating the revised annual throughput to a maximum of 710,000 Tons Per Year (TPY). The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application. The Charles Point Resource Recovery Facility is an existing waste to energy facility producing 60 megawatts of electrical power located in Peekskill, Westchester County, New York. The facility processes up to 2,250 tons per day of municipal solid waste utilizing three mass burn municipal waste combustors each designed for a maximum heat input of 325 mmBTU/hr. Each of the three Municipal Waste Combustors is equipped with dedicated emission control equipment including spray dryer absorber, fabric filter, selective non-catalytic reduction system, powdered activated carbon injection system as well as continuous emission monitors. Applicable requirements include 6NYCRR Part 202-1 (Emissions Testing, Sampling and Analytical Determinations), 6NYCRR Part 202-2 (Emission Statements), 6NYCRR Part 211 (General Prohibitions), 6NYCRR Part 215 (Open Fires), 6NYCRR Part 219-2 (Municipal and Private Solid Waste Incinerator Facilities), 6NYCRR Part 225 (Fuel Composition and Use-Sulfur Limitations), 6NYCRR Part 226 (Solvent Metal Cleaning Processes), and 40CFR Part 60 Subpart Cb (Emission Guidelines and Compliance Times for Municipal Waste Combustors that are constructed on or before December 19, 1995.) The facility's potential air emissions for carbon monoxide, oxides of nitrogen, total hazardous air pollutants, hydrogen chloride, hydrogen fluoride, sulfur dioxide, and particulates exceed the major source pollutant thresholds listed in 6NYCRR Subpart 201-6. Therefore, the facility is subject to the provisions of Title V permitting. The Standard Industrial Classification for this facility is 4953 - Refuse Systems. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit. In accordance with 6NYCRR Parts 621.5(d) and 201-6.4, the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with the applicable requirements of the Clean Air Act of 6NYCRR Part 201. The Application and Draft Permit are available for review at the Regional Office of the NYSDEC.
